Punishment for Corrupt Officials

The Government is considering a set of proposals to cut the time taken to penalise delinquent Government officials including sacking of officials found to be involved in corruption.


The Government had appointed a three member Committee of Experts to examine and suggest measures to expedite the process involved in Disciplinary/Vigilance Proceedings. The Committee has made a number of recommendations aimed at reducing time taken in conducting and concluding disciplinary proceedings against government servants. In its Report, the Committee has recommended :


· Creation of panels of Inquiry Officers from amongst both serving and retired government servants and enhancement of remuneration for conducting inquiries;


Prescribing a time limit of two months for completion of minor penalty disciplinary inquiries and 12 months for major penalty disciplinary inquiries;


Dispensing with second stage consultation with CVC;


Dispensing with consultation with UPSC in minor penalty disciplinary cases;


Setting up of Vigilance Commissions with statutory status in the States;


Introduction of Plea-Bargaining in major penalty disciplinary inquiries;


Major penalty of compulsory retirement to include cut in pension/gratuity;


Amendment of Article 311 of the Constitution to provide for dismissal from service on charges of corrupt practices after beginning of trial in a competent court;


The Report of Committee is under examination.


This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri V. Narayanasamy in written reply to a question in the Lok Sabha today.

AFTER SMALL VACATION: IMPORTANT NOTES FOR MEMBERS




After a small vacation, in the festive periods of Rakshabandhan & Janmashtami, I resume on my desk. There were also few problems in connecting internate. Now sound arrangements are being made for regular online connectivity and exchange of view and news with our members.



During the period, the Circle Union was not resting. A Four Monthly Meeting was held at Circle Office, Ahmedabad and also a Bimonthly meeting was held at the office of PMG Vadodara . Besides formal discussions on union items on record, various problems were informally discussed with the administration in a cordial atmosphere. The issues which are informally discussed and would be taken as formal items were pertaining to proper maintenance of computer systems, disposal/condemnation of old equipments, supply of high speed line printers at the Speed Post Nodal Offices at Ahmedabad, posting/deputation of OAs at PSD Ahmedabad, separating technology branch at every Divisional Office, problems of female staff in compulsory overstay in office particularly when power supply fails till late evening, Non grant of monthly meetings at Navsari division by the Divisional Head, delay in clearance of MACP at Valsad division, bias and revengeful approach of Ex.SPO Mahesana in writing ACRs and several other issues were taken up. We always try hard to properly communicate our problems and find out amicable solutions by discussions.



The Circle Union is also bothered about so many innocent officials remaining under suspension and facing disciplinary cases at Vadodara and Ahmedabad GPO. We do not support any culprit who is blameworthy for his deliberately unfair venture but we are always with innocent employees stressed by the department on account of procedural lacuna or trivial unintentional errors of work and when contributory responsibilities are forced for no valid reasons.



Circle Union is also concerned about several employees of Gandhinagar division whose transfers to Ahmedabad City division or GPO are pending though a number of their juniors/successors have been transferred. The matter is under correspondence with the concerned authorities including Circle Office. The details cannot be posted here.



Com.R.J.Patel DS Patan Dn, one of our senior and loyal comrade, resigned from the responsibility as a Divisional Secreary on account of personal circumstances. He will continue his active contribution towards our union in the division as well as circle union effectively. Circle secretary, accompanied by Com.S.K.Vaishnav Asst CS, Com. M.G.Dulera Circle Finance Secretary and also Com. Mahesh K. Chauhan Ex. DS Ahd GPO, visited Patan division and held a staff meeting which was presided over by Com.Akhani, Divisional President. There were 35 new members yearning to join/rejoin as member of our union. The charge of Divisional Secretary has been recently handed over to Com.Raval OA DO Patan. Circle union conveys best wishes to him with an advice to concentrate on understanding problems of employees and compose his best efforts for solutions.



Circle Union congratulates all young officials who have cleared examination and entered in Postmaster Cadre Grade I.



Bimonthly meeting of Head Quarter region will be held at C.O. Ahmedabad on 29.08.2011. Bimonthly meeting of Rajkot region will be held on 09.09.2011. Details of items will be made available later on. Circle Secretary will also attend a Monthly meeting of Kheda division on 01.09.2011.



All Divisional Secretaries and Members are invited to kindly give proper feedback/details of their problems with their suggestions for best possible remedial action. Please keep watch, visit Post Offices, meet members and collect details of their problems. Ensure that Clean and cold drinking water is available, drainage in POs and colonies are in order, proper lavatory blocks are available, years old problematic computers are not placed on, History sheets are available and condemnation of old computers are done, Printers are available and working, required furniture is available, personal claims are not long pending, there is no undue suppression on staff from any corner, staff is not facing frequent disciplinary action on small matters, maintenance of P&T Colonies is done regularly, there is no cases corruption etc. So many areas await for your visualization. Please recognize this feature and heroically & courageously carry on your responsibility.



Some mischievous elements had hawked Email ID of CHQ and sent messages for sending some amounts. The old Email ID of CHQ has been discontinued. New Email ID will be as : aipeugrc@gmail.com. This is for information of all members.



Central Working Committee of our union will be held on 2-3 October, 2011 at Jabalpur but Circle Secretary will be unable to attend the same. During Navratri period, commencing from 28.09.11 to 07.10.11, C/S will remain only at Junagadh for handling of Navratri related popular public Garba/events constantly for ten days, which he does since last 25 years.



Again all Divisional Secretaries are requested to clear their quota for the previous year and by end of September 2011 remit 6 months quota for the current year. Please don’t send small lump sum amount. Rs.8/- per member per Month has to be remitted.

Subject: Consideration of persons with disabilities for promotion against unreserved vacancies-reg.

The undersigned is directed to say that representations have been received stating that some Ministries/Departments etc. do not consider the persons with disabilities for promotion to Group 'A' and Group 'B' posts, even if such posts are identified suitable for them, on the ground that there is no reservation for persons with disabilities in the matter of promotion to such posts. In this regard, attention is invited to para 6 of this Department's OM No. 36035/3/2004-Estt.(Res) dated 29th December, 2005, which provides that a person with disability cannot be denied the right to compete for appointment against an unreserved vacancy in a post identified suitable for persons with disability of the relevant category. It is hereby clarified that if promotions are made to a Group 'A' or Group 'B' post, which is identified suitable for persons with disability of a specific category, the persons with disability of relevant category in feeder grade, if any, shall be considered for promotion to the post by applying the same criterion as applicable to other persons.

CLASSES OF PENSION

SUPERANNUATION
A superannuation pension shall be granted to a Government servant who is retired on his attaining the age of 60 years.
RETIRING PENSION:
A retiring pension shall be granted to a Government servant who retires, or is retired before attaining the age of Superannuation or to a Government servant who, on being declared surplus opts, for voluntary retirement.

VOLUNTARY RETIREMENT:
Any Government servant can apply for voluntary retirement, three months in advance, only after the completion of twenty years of his qualifying service, provided there is no vigilance or Departmental Enquiry pending /initiated against him/her.
INVALID PENSION:
Invalid Pension may be granted if a Government servant applies for retirement from the service on account of any bodily or mental infirmity which permanently incapacitates him/her for the service. The request for invalid pension has to be supported by medical report from the competent medical board.
COMPENSATION PENSION:
If a Government servant is selected for discharge owing to the abolition of a permanent post, he shall, unless he is appointed to another post the conditions of which are deemed by the authority competent to discharge him/her to be at least equal to those of his own, have the option –
(a) of taking compensation pension to which he may be entitled for the service he had rendered, or
(b) of accepting another appointment on such pay as may be offered and continuing to count his previous service for pension.
COMPULSORY RETIREMENT PENSION:
A Government servant compulsorily retired from service as a penalty may be granted, by the authority competent to impose such penalty, pension or gratuity, or both at a rate not less than two-thirds and not more than full compensation pension or gratuity, or both admissible to him on the date of his compulsory retirement. The pension granted or allowed shall not be less than Rs. 3500/- p.m.
OMPASSIONATE ALLOWANCE:
(i) A Government servant who is dismissed or removed from service shall orfeit his pension and gratuity:
Provided that the authority competent to dismiss or remove him from service may, if the case is deserving of special consideration, sanction a compassionate allowance not exceeding two-thirds of pension or gratuity or both which would have been admissible to him if he had retired on compensation pension.

(ii) A compassionate allowance sanctioned under the proviso to sub-rule (i) shall not be less than the amount of Rupees one thousand nine hundred and thirteen per mensem.
EXTRAORDINARY PENSION:
Extraordinary Pension in the form of Disability pension/extraordinary family pension may be paid to the Government servant/his family if disablement/death (or the aggravation of disablement/death)of the Government servant, during his service, are attributed to the Government service. For the award of extraordinary pension, there should thus be a casual connection between disablement and Government service; and death and Government service, for attributability or aggravation to be conceded. The quantum of the pension, however, depends upon the category of the disablement/death.
Government servants appointed on or after 1.1.2004 are not covered by the CCS(Extraordinary Pension) Rules.

FAMILY PENSION:
Family pension is granted to the widow / widower and where there is no widow / widower to the children of a Government servant who entered in service in a pensionable establishment on or after 01/01/1964 but on or before 31.12.2003 or having entered service prior to that date came to be governed by the provisions of the Family Pension Scheme for Central Government Employees, 1964 if such a Government servant-
(i) dies while in service on or after 01/01/1964 or

(ii) retired/died before 31.12.1963 or
(iii) retires on or after 01/01/1964
and at the time of his death was in receipt of pension.

Family pension is payable to the children up to 25 years of their age, or marriage or till they start earning a monthly income exceeding Rs.3,500/- + DA admissible from time to time p.m. whichever is earlier.

Widow daughter / divorced daughter/ unmarried daughter of deceased Government servant is also entitled for the family pension till her remarriage or up to life time or starts earning a monthly income exceeding Rs.3,500/- + DA admissible from time to time p.m. whichever is earlier.

Family pension is also payable to the dependent parents of deceased Government servants w.e.f. 01/01/98, where there is no claimant i.e. spouse or child for family pension, alive.

If the son or daughter, of a Government servant is suffering from any disorder or disability of mind or is physically crippled or disabled so as to render him or her unable to earn a living even after attaining the age of 25 years, the family pension can continue to be paid for life time subject to conditions.

Sub: ADMISSIBILITY OF SEVERANCE AMOUNT TO GRAMIN DAK SEVAKS ON RETIREMENT/DEATH AND ON ABSORPTION ON REGULAR POSTS-CLARIFICATION REGARDING.

Attention of all concerned is invited to Annexure-III of this Directorate order No. 6-1/2009-PE.II dated 08.10.2009 containing details of existing and revised benefits under nature of benefit named 'Severance Amount'.

2. In this context, it is to clarify that the present benefit shown against Severance Amount also includes Severance Amount on absorption on regular posts payable @ Rs. 20000/- (Rs. Twenty thousand only) to an EDA (now called GDS) absorbed on regular basis against a departmental post after 15 years of continuous service as ED Agent (now called GDS) in the light of the common recommendation made by the GDS Committee in Para 14.14.1. Therefore, the revised benefit indicated against nature of benefit 'Severance Amount' is applicable not only on retirement/death but also on absorption against departmental posts @ Rs. 1500 for every completed year of service subject to maximum of Rs. 60000 with reduction in minimum eligibility to 10 years.
3. Therefore, the words "Severance Amount on retirement/death" may be taken as inserted on the top as headline above the existing para under present benefits against 'Severance Amount' starting with "A lump sum severance amount and ending with amount paid is Rs. 20000." Below this para, a new headline as "Severance Amount on absorption on regular posts" & a para beneath it starting as "Severance amount of Rs. 20000 (Rs. Twenty thousand only) is paid on absorption on regular basis against a departmental post after 15 years of continuous service" may also be taken as inserted & accordingly the Annexure III to this Directorate Order No. 6-1/2009-PE II dated 09 Oct 2009 may be taken as amended. Confederation's National Secretariat Meeting was held in Chennai City [Tamilnadu] on 29th July, 2011. Tamilnadu State Committee of Confederation had made excellent arrangements for the conduct of the Secretariat Meeting. Along with the Secretariat, the National Women Sub Committee of Confederation also had its session. The Circular containing the details of the Secretariat Meeting and the Women Committee meeting is placed hereunder for the information of all Affiliates - SG Confederation.

Dear Comrades,
NATIONAL SECRETARIAT MEETING AND ITS DECISIONS.
The meeting of the National Secretariat of Confederation was held at Chennai on 30th July, 2011. Comrade S.K.Vyas President was in Chair. The following decisions were taken.

1. The campaign for popularising the charter of demands adopted at the National Council meeting held at Mumbai on 1st December, 2010 could not be undertaken in an effective manner as the major affiliate NFPE had to be busy with the preparation of the indefinite strike action.

2. The meeting decided that prior to any action programme; an intensive campaign is a pre requisite. Accordingly the following programmes were chalked out.
(a) Every affiliate will circulate the charter of demands along with the explanatory note amongst the employees. Meetings will be organised in front of all offices to explain the demands to the members. Report of such meetings will be sent to the Confederation CHQ directly. These meetings are to be organised between 5th and 10th September, 2011.
(b) Between 10th and 20th September, 2011 the State Committees of the Confederation will ensure that district level conventions are held and one of the State Committee member deployed to attend such convention in each district. The Sate Committees will send the report of these conventions to the CHQ.
(c) On 28th September, 2011 a massive Dharna programme will be organised in all State Capitals, district and divisional offices. At the State Capitals, a minimum number of 100 comrades will sit in Dharna. Lunch recess demonstrations will also be organised on the same date at the Dharna venue. One of the National Secretariat Members will attend the Dharna programme in each State Capital.
(d) All affiliates will organise a department level convention eliciting participation of the State level Executive on a date convenient to them but before 10th October, 2011. One of the National Secretariat members will make it convenient to attend such conventions.
(e) Rally and demonstration will be held in front of the office of the Chairman, Welfare Co-ordination Committee or any other central located place jointly by all the CGEs in all state capitals on 20th October, 2011.
(f) Immediate steps will be taken by all affiliate to circulate the petition to the Prime Minister on PFRDA bill. Copy of the petition will be handed over to each member to obtain his signature as also his family members and friends. The State Committee will hold a review meeting on 10th October, 2011 to monitor the progress and take necessary steps to expedite the campaign.
(g) The National Secretariat will meet at Bangalore on 22nd October, 2011 to review the implementation of the programme of action including the signature campaign and take necessary action to remove deficiencies if any noticed.
(h) The Confederation will mobilise 10000 employees to participate in the ensuing march to Parliament (date will be finalised by the Steering Committee by end of August, 2011).
(i) To organise a day's strike jointly by all the organisations which participated in the 22nd July convention. The date for the strike will be finalised by the steering committee.
The declaration adopted at the convention, the draft letter to the Prime Minister demanding withdrawal of the PFRDA Bill, campaign leaflet on PFRDA Bill are sent herewith. (Copies of the same are also placed on our website).
NATIONAL WOMEN COMMITTEE OF CONFEDERATION MET AT CHENNAI.
The Women committee constituted by the National Women Convention held at Kolkata met at Chennai on 30th July, 2011. The Committee took the following decision. The meeting was presided over by the Chairperson, Com. Geeta Ghoshal and the proceedings were initiated for discussion by Com. C.P. Shobhana, Convenor.

1. To organise the International women's day on 8th March, 2012 at all State Capitals by organising a seminar on the subject "impact of the neo-liberal economic policies on women and women workers in particular"
2. To organise a State level Convention of women employees of the Central Government during September/October, 2011. The State Committees of the Confederation will take necessary steps to hold the convention.
3. To hold a demonstration in a prominent Central Government office by women workers in all State Capitals against the unabated price rise of essential commodities. The date will be finalised and intimated later. Steps will be taken to have massive participation of all women employees of Central Government in this programme by the State Committees.

DECISIONS OF FEDERAL EXECUTIVE OF NFPE HELD AT LUCKNOW ON 26TH & 27TH JULY, 2011
1. All India Study Camp of NFPE will be held at Allahabad (U.P.) in the month of December-2011 or January: 2012.

2. Postal CASUAL , Part Time, Contingent Employees, All India Convention will held at Tirupati (AP) during the month of November - 2011.

3. State level Conventions, Mahila Conventions and Trade Union Camps will be organized from January, 2012 onwards.

All India Conference of A.I.P.E. Union Postmen & MTS (Gr. 'D' ) will be held at Pushkar (Ajmer) Rajasthan from 25th to 27th September-2011

All India Conference of A.I.R.M.S. & MMS Employees Union Group 'C' will be held in U.P. Circle .Date & Venue ill be intimated later.

All India Conference of A.I.R.M.S. & MMS Employees Union Mail Guards & Muklti Tasking Staff Group 'C' will be held at Guwahati (Assam) from 8th to 10th October, 2011.
RESOLUTIONS ADOPTED IN FEDERAL EXECUTIVE OF NFPE HELD AT LUCKNOW ON 26 & 27 JULY, 2011
THIS FEDERAL EXECUTIVE MEETING OF NFPE HELD AT LUCKNOW FROM 26-07.2011 TO 27.07.2011 AFTER DETAILED DELIBERATIONS ON ALL ISSUES RELATED TO THE PROPOSED INDEFINITE STRIKE FROM 2011 JULY 5TH HAS RESOLVED THE FOLLOWING:

1. This Federal Executive has come to the unanimous conclusion that, under the given circumstances the settlement reached with the Administration on the 25 points Charter of Demands is the best possible and fully ratify the decision of the JCA to defer the strike.

2. This Federal Executive further direct the NFPE & JCA leadership to take follow up action to get orders released on all the agreed items in a time bound manner.

3. This Federal Executive demand the Secretary, Department of Posts, to arrange another review meeting on the PLI related issues as the decentralization of certain important PLI/RPLI functions to Divisions has been done contrary to the sprit of the discussions held on 01.07.2011. Review meetings may also be arranged with the unions of Civil Wing and Postal Accounts as assured during the final round of discussion.

4. Regarding the formation of the Committee to review the Speed Post hubs and first class hubs (L 1,L 2) the Federal Executive is of the unanimous view that the induction of new technology and consequent changes in the mail processing should not lead to indiscriminate closure/merger of existing RMS Offices and interest of employees should be protected. The delay in public mail should be avoided and speedy delivery of articles should be ensured.

5. The Federal Executive further resolve that if any unilateral violation of the assurances given to the Staff Side take place then NFPE and JCA shall organize agitational programmes.

Sir/Madam,
I am directed to state that the issue of organizing frequent meetings/melas on holidays and Sundays, thus depriving the employees of their legitimate right to avail the break was considered in a meeting taken by Secretary to discuss charter of Demands served with the notice of indefinite strike w.e.f. 05.07.2011 by Postal Joint Council of Action.
2. While in certain circumstances it may be unavoidable strategically beneficial for the Department to hold meetings/melas etc on holidays and Sundays, it may not be done so in a routine manner. Needless to say, the weekly break and holidays etc. have their own significance and it may be kept in view while calling the officials for duty during the break.
3. This may be brought to the notice of all concerned.
