CONFEDERATION ENDORSES MOVEMENT LAUNCHED BY THE WORLD FEDERATION OF TRADE UNIONS ON FIVE BASIC ISSUES FOR HUMAN EXISTENCE

CONFEDERATION CIRCULAR NO. 15  DATED 03RD SEPTEMBER,
Conf/ 15/2012                                                                                Dated: 3rd September, 2012
Dear Comrade,
The Word Federation of Trade Unions was founded in a Conference held at Paris from 3rd to 8th October, 1945. It had its deepest crisis when the socialist system collapsed in the erstwhile USSR.  The 15th Congress of WFTU was held at Havana in 2005.  The said Congress helped to revive the active functioning of the WFTU.  The 16th Congress was held at Athens, Greece in April, 2011.  It was a grand success and paved way for the WFTU to become a potent organisation to lead the international working class to militant struggles against the Globalisation agenda of capitalist system.  One of the decisions taken at the Congress was to observe the international day of action every year to unite the working class throughout the world for action on certain important contemporary class issues.  Ist April, 2009 was thus observed as international day of action to raise the issue of workers right and against exploitation.  On 7thSeptember, 2010, when the Indian Working Class organised the greatest ever strike action under the auspices of the united platform of all Central Trade Unions and Federations, the day was observed by WFTU with the slogan that "We will not pay for their crisis".  It was in the background when most of the capitalist countries decided to bail out the giant corporate houses from crisis by tax payers' money.  In 2011 the day was observed on 3rd October  i.e. the foundation day of WFTU and the slogan raised was "Social Security for all, collective bargaining rights, trade union rights and democratic rights, 35 hours of work and 5 day week, better wages etc.
The Confederation had been carrying out this directive of the WFTU being an affiliate of the TUI, public Services.  In the face of the pension fund privatisation and the PFRDA Bill, the slogan for social security for all raised by the WFTU received appreciation from the rank and file of our membership. The other issues raised by the WFTU were also equally relevant and important for the Government employees of India for they are still denied the right to collective bargaining and other trade union rights.  India, we should remember, is one of the countries of the world, which has still not ratified many of the ILO conventions.
This year, the WFTU has decided to raise the following five issues which are of utmost and essential pre requisite for human existence.   i.e. Food, Water, health, Education and Housing for all. Both the CITU and AITUC which are affiliated to the WFTU will be organising this programme throughout our country on 3rd October, 2012.  As an affiliate of TUI Public Services, it is our bounden duty that we observe 3rd October, 2012, with appropriate programmes so that the message reaches all our members.
The State Committees may chalk out either independent programme of action or hold joint programmes in consultation and association with the State Units of the All India State Government employees Federations, CITU or AITUC.
                With greetings,
Yours fraternally,
K.K.N. Kutty
Secretary General

MINUTES OF THE MEETING HELD ON 28th AUGUST, 2012 REGARDING • REVISION OF PPOs FOR PRE-2006 PENSIONERS/FAMILY PENSIONERS INCLUDING PRE-1990 PENSIONERS FAMILY PENSIONERS

A meeting was held on 281h August, 2012 at 11:30 AM in the Conference Room, 5th Floor, Sardar Patel Bhavan, New Delhi under the Chairmanship of Shri Sanjay Kothari, Secretary (Pension, AR&PG) with the officials of 15 Departments/Ministries having maximum number of unrevised Pension Payment Orders (PPOs) pertaining to pre-2006 pensioners/Family pensioners. The objective of this meeting was to review the progress made by these Ministries/Departments in the revision of PPOs in respect of pre-2006 pensioners.
2.    The list of participants is at Annexure — I.
3.    Opening the discussion, Secretary (Pension, AR & PG) said that the areas of concern for this Department were the outstanding cases of pre-2006 pensioners. He felt the cases of pensioners should be dealt with sympathetically emphasizing the fact that all of us would be pensioners in future.. He stated Ministries where pendency was quite large and it .was not feasible to clear the pending cases with the existing staff, avenues. for appointment of Consultant may be explored so that the work of revision of pension for pre-2006 pensioners does not suffer.
4.    Secretary (Pension, AR & PG) then took up the Ministry-wise figures, starting with Ministry of Home Affairs (MHA), which has the largest number of pending cases. The representative of MHA, informed that in pre-1990 cases there are limitations of availability of records and finding out the status whether pensioners are alive and non-receipt of Annexure III. The cases falling under Extraordinary Pension Rules and Liberalized Pension Awards have to be processed manually. Therefore, their clearance may take longer time. Ministry of Home Affairs informed that information contained in Annexure III may not be sufficient in the case of pre-1990 cases. Ministry of Home Affairs also stated that despite publishing an advertisement in the newspapers for getting the missing information with respect to pre-.2006 pensioners, they had not received adequate response to the same. It was further informed that information required for the purpose is not being provided by the _pensioners/family pensioners concerned either. Secretary (Pension, AR & PG) advised them to launch a drive to clear the pending cases.
5.    Secretary (Pension & AR &PG) suggested that all Departments should make one more effort to elicit response from pensioners. An advertisement may be posted on. the website of Department of Pension and PW indicating therein to contact DD0s/HOOs in the Departments who are willing to respond to the queries of the pensioners in this regards. Department of Personnel Sr. Training, Department of Financial Services, CBDT, CBEC and D/o Pension & PW were agreeable to putting up an advertisement on the web-site of Department of Pension & PW for the pensioners to provide the information specific to them which is required for revising the cases. In case other Ministries also desire they will also be included. (Action-Ministries desirous of putting up the advertisement)
6.    Some of the salient points emerged during the discussions are as under:-
i). CPAO. Informed that they had taken a meeting with the representatives of all Associations of Pensioners and requested them to help pensioners to send their information for revision of their PPOs. CPAO also informed that the Department- wise pendency was already available in the web-site which may be referred to by the Ministries/Departments while clearing the cases.
(ii) In cases of family pension, date of birth of the spouse is a mandatory figure. it is informed that in cases where no information is available, instruction about treatment of date of birth as circulated vide Department of Pension & Pensioner Welfare OM No. 38/37/08-P&PW(A), dated 21/05/2009 and No. 1/19/2011- P&PW(E), dated 03/08/2011 (copies enclosed) may he followed. CPAO had raised some queries in this regard recently. A copy of this Department’s ID Note, dated 15/05/2012 in response thereto is also enclosed for information.
A special drive may be undertaken by all Departments to liquidate the pending cases. Efforts should be made to liquidate pre-2006 cases by 31sE December, 2012 and pre-1990 cases by 31st March, 2013. (Action-All Ministries/Departments)
In respect of pre-2006 pensioners, Ministry of Home Affairs agreed to reduce the pendency to less than 5000 by the end of December, 2012. Ministry of Urban Development agreed to reduce the number to 1000 by this period. Ministry of Information & Broadcasting agreed to bring down the pendency to 50%. Other Ministries agreed that pendency figures will be reduced to less than 500 by the end of December, 2012. (Action – all Ministries/Departments)
(v) It was felt that since the pensioners were in direct contact with the Banks, the system of nodal officers in various Banks may be strengthened. In this regard necessary action may be taken by Department of Financial Services. The banks could provide guidelines to the pensioners to approach the concerned Pay & Accounts Officer/HODs concerned for getting their PPOs revised, in such cases which are not yet revised. As the Banks were continuously sending Annexure III in duplicate and at times in triplicate also, it was felt that the Ministries in coordination with PAOs and with the help of CPAO may send pensioners’ specific information to the Banks for the remaining pending cases so that information received from the Banks can be used more fruitfully. The Department of Pension & PW will also place the link of the nodal officers of various banks in their website for the benefit of pensioners. (Action – all Ministries/Departments, CPAO, Department of P&PW, Department of Financial Services)
7.    In view of the huge pendency of pre-2006 revision of pension cases, Secretary (Pension, AR & PG) stated that he would be writing to all the Secretaries concerned- asking them to review the pendency regularly. He also asked that various Ministries may include this as an agenda item for the senior officers meeting being held regularly in various Ministries so that the pendency can be reduced to zero.
8.    The meeting ended with a vote of thanks to the Chair.

NEW HEALTH INSURANCE SCHEME FOR CG EMPLOYEES AND PENSIONERS

We all know Sixth Pay Commission recommended for New Health Insurance Scheme in lieu of present CGHS. Though employees covered under CGHS have apprehensions whether this proposed new scheme would be better than existing CGHS, in respect of employees residing in Non-CGHS area this scheme is definitely a boon.
The present CS Medical Attendance Rules under which employees residing under non-CGHS area are covered has no real intention to provide for proper medical treatment be it In-Patient or Out-Patient treatment as the cost reimbursed under CS Medical Attendance Rules would be a paltry sum compared to the actual cost of medical treatment in non-CGHS areas.
In the case of Pensioners too residing in non-CGHS areas, the fixed medical Allowance of Rs.300 per month provided to them may not be even sufficient to meet out the cost for one visit to a nearby Doctor for cold.
Under these circumstances, Central Government Employees and Pensioners residing in non-CGHS are really in need of good medical treatment at par with their colleagues in CGHS Areas. When New Medical Insurance Scheme was proposed by Government in the year 2008 as per the recommendations of 6CPC, it was believed that it would come as a relief for employees and pensioners in non-CGHS area.
But this scheme is still not a reality as in spite of repeated promises in the Lok Sabha and Rajya Sabha that the scheme would be implemented soon, it it yet to take off.
Now, on 28.08.2012, there was another query regarding implementation of this Scheme for which Health Ministry has replied as follows
GOVERNMENT OF INDIA
MINISTRY OF HEALTH AND FAMILY WELFARE
RAJYA SABHA
HEALTH INSURANCE FOR CGHS BENEFICIARIES
UNSTARRED QUESTION NO-1775 by SHRI BASHISTHA NARAIN SINGH
a) whether it is a fact that in the year 2010, Government mooted a plan to provide health insurance scheme to its serving and retired employees;
(b) if so, the present status of that scheme;
(c) whether it is also a fact that beneficiaries including Members of Parliament are not getting required medicines from dispensaries specially Ayurvedic dispensary of North Avenue and elsewhere; and
(d) if so, by when Government would seriously consider providing health insurance cover to CGHS beneficiaries in order to provide better healthcare?
ANSWERED ON-28.08.2012
(a) & (b): There is a proposal for introduction of a health insurance scheme for central government employees and pensioners on pan-India basis with special focus on pensioners living in non-CGHS areas. As per the directions of the ‘Committee of Secretaries’, a proposal for inclusion of this scheme in the 12th Five Year Plan has been sent for consideration of the Steering Committee of the Planning Commission, before placing the same for approval of the competent authority.
(c) : No.
(d): No specific time frame can be given for introduction of the proposed health insurance scheme.

ENHANCEMENT OF PENSION TO WORKERS

A proposal of the Pension Implementation Committee (PIC), a Sub-Committee of the Central Board of Trustees, Employees’ Provident Fund (EPF) to enhance the minimum pension under Employees’ Pension Scheme, 1995 to Rs. 1,000 is under consideration of the Government.
The Union Labour & Employment Minister Shri Mallikarjun Kharge gave this information in a written reply in Lok Sabha today.

SENSITIVE APPROACH TOWARDS WOMEN EMPLOYEES

Article 16 of the Constitution of India guarantees equality of opportunity for all citizens in matters relating to employment or appointment to any office under the State. Further, it provides that no citizen shall, on grounds only of religion, race, caste, sex, descent, place of birth, residence or any of them, be ineligible for, or discriminated against in respect of, any employment or office under the State.
To enhance the employability of women, the Government is providing skill training to women through a network of Women Industrial Training Institutes. There are 11 National Vocational Training Institutes providing training facilities, exclusively for women in skills having high wage-employment and self-employment potential. Further there are women wings in general ITIs which are under the administrative control of respective State Governments. National Council for Vocational Training (NCVT) has enhanced the percentage of reservation for women from 25% to 30% in training institutes.
Besides this, the Government has enacted the Equal Remuneration Act, 1976 which provides for payment of equal remuneration to men and women workers for the same work or work of a similar nature without any discrimination and also prevents discrimination against women employees while making recruitment for the same work or work of similar nature, or in any condition of service subsequent to recruitment such as promotions, training or transfer. The Government has taken several steps for creating a congenial work environment for women workers and a number of protective provisions have been incorporated in various labour laws. These include provision of crèches where a certain number of women are employed, maternity benefit and safeguards against sexual harassment of women workers at their work places, etc. With these efforts more and more women would be encouraged to take up employment. However, it is difficult to quantify the number of women likely to be benefited therefrom.
This was stated by Smt. Krishna Tirath, Minister for Women and Child Development, in a written reply to the Lok Sabha today.

SIBAL FOR SEPARATING REGULATORY SERVICES FUNCTIONS OF DOP

Communications and IT Minister Kapil Sibal has called for restructuring of 150-year-old Department of Post by separating its regulatory and services functions to meet challenges of technological age.
“The postal department should also restructure itself to meet challenges of 21st century. The Department of Post (DoP) should look into prospect of bifurcating the Ministry from the regulator and the operator, just as was done in the telecom sector,” Sibal told PTI.
He said that the DoP should explore possibility of having different entities namely policy making, regulator and service provider.
“No decision has been taken yet. It is all a matter of debate and dialogue at the moment,” Sibal said.
DoP, which has around 5 lakh employees, is responsible for policy making, regulation and providing postal services, at present.
The over 100-year old Indian Post Office Act bars any individual or entity from delivering letters for commercial purpose. The business of private courier companies is built around delivering documents, parcels and others items which do not fall under the category of ‘letter’.
Sources in the Ministry said that Sibal held a meeting with DoP officials early this week on the issue of finanlisation of the National Postal Policy 2012 and asked them to prepare roadmap for restructuring as well.
They said that next meeting on the issue is expected to take place in 15 days.
They said that the Minister, in June, had asked DoP to set up a body to oversee the unbundling of its functions.
An independent body named Postal Development Board (PDB) will be responsible for the overall development and governance of the postal sector, they added. The PDB will also draw a road-map for unbundling of postal department functions.
The Minister had also instructed DoP to constitute a Postal Advisory Board (PAB), in line with Telecom Commission, which should have representation from Government, industry players, academics and other stakeholders, they said. The role of PAB will be to provide inputs to PDB on policy matters.
The government in 1997 created the Telecom Regulatory Authority of India (TRAI) to regulate the sector. Under New Telecom Policy 1999, Government further restructured DoT by separating service providing function from it.
