Respected Sir,
Namaskar. There will be no possibility of crediting salaries in SB accounts of employees on 1-4-16 because of year ending process in Finacle besides very poor access during last 3 weeks. There may not be any transactions in CBS offices on 1-4-16.

As per  statutory rules & as per Controller General Accounts Manual Part III, Rule 64 payments of pay & allowances are to be made on last working day and in case of March, on 1st April to the employees. 

It is requested to issue instructions to all DDOs to effect payment of pay & allowances on 1-4-16 by cash on acquittance rolls and payment of pension manually on 1-4-16.

FUNCTIONING OF CBS



            Today on dated 28.03.2016, Com. R.N. Parashar Secretary General NFPE along with Com. D. Theagarajan Secretary General FNPO met with Shri V.B. Sudhakar, Member (Technology) and Shri Ashutosh Tripathi, Member (Personal) and apprised of the worst situation being faced by Postal Staff due to CBS.

            After detailed discussion, the following remedial measures have been declared by the Department.

    1. Two to three levels of EOD will be done centrally from CEPT,     Mysuru from 1st April, 2016.

    2. Two additional servers are being provided at the Data Centre     today so that additional load can be absorbed.

    3. The Business Continuity Plan (BCP) has been permitted by the     FS Division from 23.03.2016. This will enable operations to be     done across the counter.

    4. An Emergency Response Team (ERT) has been constituted at  CEPT, Mysuru to deal with outages.

    5. A top to bottom review of the Application is being undertaken     to ensure smooth operations.

        Your co-operation is sought for effective implementation of CBS.

Cabinet approved 6% DA and DR for Central Govt Employees and Pensioners from Jan 2016


Release of additional instalment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners due from 1.1.2016
The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has approved release of an additional instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.01.2016. This represents an increase of 6 percent over the existing rate of 119 percent of the Basic Pay/Pension, to compensate for price rise.
This will benefit about 50 lakh Government employees and 58 lakh pensioners.
The increase is in accordance with the accepted formula, which is based on the recommendations of the 6th Central Pay Commission (CPC). The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be of Rs. 6796.50 crore per annum and Rs.7929.24 crore respectively, in the financial year 2016-17 (for a period of 14 months from January, 2016 to February, 2017).

NOTICE ISSUED. LET US SHOW ROCK LIKE UNITY FROM 15-4-16. WE WILL LEAVE OFFICES AT THE END OF DUTY HOURS. UNITED WE STAND. DEVIDED WE FALL.

हम डाक कर्मचारी अब थक चुके है. जवाबदार और मुख्या (बड़ा) यूनियन होने की वजह से हम अपने स्टाफ को डाक विभाग की प्रगति, आधुनिकीकरण और तकनीकीकरण में निरंतर सहयोग देने के लिए आजतक प्रोत्साहित कर रहे है. लेकिन सर्वर डाउन ही हो जाता है, फिनॅकल सॉफ्टवेयर चल नहीं रहा, नेटवर्क भी ठीक नहीं, महत्तम डाकखानों में हार्डवेयर भी पुराने कंडेम्न करने लायक चला रहे है. कब तक हमारा स्टाफ देर रात तक घर परिवार की कोई भी जवाबदारी निभाए बिना ऑफिस में बैठा रहेगा?

व्याज दरो में १-४-१६ से कटौती हो रही है. इस कारन एजेंट्स और कस्टमर्स नए एकाउंट्स ले कर आ रहे है. इस सभी कार्य को पूरा करने के लिए सर्वर, सॉफ्टवेयर और नेटवर्क चलेगा ऐसी किसको गैरंटी है! कौन जवाबदारी लेगा? क्या ३१ मार्च तक जो भी और जितना भी काम आये, उसे स्वीकारा जाये? उसे कैसे पूरा करना है और किसको कब यह सब करना है? इन सभी सवाल हरेक डिविजनल सेक्रेटरी को अपने यूनिट के मुख्या (एसपी /एसएसपी) को पत्र लिख कर उठाने चाहिए.

यूनियन भी मौन रहेगा, अधिकारी भी मौन रहेंगे तो दूर दूर तक काउंटर पर बैठे हमारे स्टाफ की हालत कैसे सुधरेगी? इस लिंक में प्रस्तावित पत्र सभी डिविजनल सेक्रेटरी अपने एसपी/एसएसपी को लिखे ऐसा गुजरात के सभी यूनिट को आदेश दिया जाता है. और लोग भी ऐसे ही अपने क्षेत्र में नेतागण को विश्वास में ले कर कर सकते है.

न कोई अधिकारी कुछ पूछ रहा है, न ओवरटाइम अथवा कम्पेन्सेटरी ऑफ देने की सोच रहा है, न टी किस किस दिन किस ऑफिस में कौन कौन देर रात  तक बैठा था उसकी नोट्स रखने का कहा जाता है. स्टाफ स्थानांतर अथवा शोषण होने के भय से इस पीड़ा को सह रहा है और अधिकारी तो टारगेट के पीछे पड़ा हुवा है. जानता हे की गलत है, फिर भी स्माल देनोमिनेशन के खाते स्प्लिटिंग करके खुलवाते रहता है. ऐसे  अनपेक्षित  लाखो नए एकाउंट्स के कारन सर्वर में डेटा जाम हो जाता है. फाइनेंस मिनिस्ट्री के साथ भी छल किया जाता है. हमारे बार बार लिखने पर भी ऐसे अति उत्साहित पीएमजी और सुप्रींटेंडेंट्स को किसी ने रोका नहीं. अगले साल ऐसे एकाउंट्स क्लोज करने में कितना टाइम और मानवशक्ति का व्यय होगा? ऐसे एकाउंट्स को इर्रेगुलर्ली ओपेन्ड एकाउंट्स करार दे कर तुरंत बंध करवा ने चाहिए और ऐसा कराने वाले अधिकारी ओ पर डायरेक्टरेट एवं फाइनेंस मंत्रालयों के साथ छल करने के आरोप लगाकर शिस्तभंग की शिक्षात्मक कार्यवाही करनी चाहिए. हमारे पत्रो और इमेल्स सर्कल ऑफिस में किस अधिकारी तक पहोचाया गया और उसमे क्या कोई सुचना दी गई थी इसकी भी जाँच होनी चाहिए.

हम सभी ने तय कर लया है की गुजरात सर्कल में सभी सर्वर,नेटवर्क,सॉफ्टवेयर,हार्डवेयर के जो भी प्रोब्लेम्स है उसे सुलज़ाना एडमिनिस्ट्रेशन का काम हैं . हम  सब  15 अप्रैल  से  अपने  कार्य  समय  की  समाप्ति  पर  दफ्तर  छोड  देंगे .

Taking responsibility and making arrangement for huge SB work at most of the POs.

Respected Sir,
Namaskar. You are aware of following two facts:

1. There is huge work of attending transactions of customers and opening of various types of accounts etc up to 31st March 2016. Most of the offices are kept working by our staff till late nights and administration has not offered O.T.A. or even compensatory off also. The flow of work will be increased and become unmanageable for the staff.

2. The Server remains down at pick hours and due to very poor and broken Net Connectivity our staff is not able to run the work in Finacle. Similar is the position of Mc Camish. How is it possible to complete work in POs?

Staff side requests to immediately review the situation and instruct all post offices, in quite clear language, whether they should accept all type of work being received on counters or through Agents? Secondly it is big question to decide who will be responsible if transactions accepted are not materialised on last day of March?

There is no surity of worth working of Server/Software/Network. In this situation whether you are agree to grant compensatory Off to concerned staff if they have to sit till late hours?

Please review, decide and issue instructions to all staff as deemed fit.

Implementation of 7th CPC : Minutes of the 2nd meeting of Empowered Committee of Secretaries (E-CoS)


Implementation of the recommendations of the 7th Central Pay Commission — 2nd meeting of the E-CoS
A meeting of the Empowered Committee of Secretaries (E-CoS) was held on 1 st March, 2016 in the Cabinet Secretariat under the chairmanship of the Cabinet Secretary to discuss issues raised by Staff„side of JCM
2. Welcoming the members of E-CoS and JCM Staffside, Cabinet Secretary observed that the meeting had been called to take a note of concerns of Staff-side of JCM regarding recommendations of the 7th CPC and invited the members Of Staff-side of JCM to share their views on the recommendations.
3. Opening the discussion, representative of Staff-side of JCM expressed gratitude to Cabinet Secretary for inviting them for interaction regarding the recommendations of the 7th CPC and requested that more frequent interactions of JCM may be held to resolve outstanding issues across the table. It was expressed that 7th CPC has recommended a meager increase of 14% in the minimum pay as against increase ranging up to 54% during previous Pay Commissions. It was further stated that the recommendations on minimum pay, allowances, advances etc. will cause difficulty to employees. Representative of Staff-side informed that they have already submitted a charter of demands to the Cabinet Secretary bringing out the issues. These have also been discussed in the meeting of JS (IC) with Staff-side of JCM held on 19.02.2016.
4. Major concerns expressed by JCM Staff-side were as under:
The minimum pay of Rs. 18000/- p.m. recommended by the Commission is on lower side and needs to be revised upward by taking into account the prices of commodities as on 01.07.2015 and appropriately factoring in for social obligations & housing.
(ii) New Pension Scheme should be done away with. Persons governed by the NPS are deprived of Family Pension and do not have provision of provident fund. As a result they are at a disadvantageous position as compared to the persons governed by the old system.
(iii) Recommendations on allowances need to be properly examined before taking a decision.
(iv) Fixed Medical Allowance should be increased from existing Rs. 500 p.m. to Rs. 2000 p.m. as majority of cities are not covered under CGI-IS and people residing outside the CGHS covered area are unable to meet their medical needs with meager amount of Rs. 500 p.m.
(v) Recommendation regarding withdrawal of non•interest bearing advances may not be accepted.
(vi) Outsourcing of services should be discouraged as the contract workers are being exploited by contractors and at the game time the service delivery is being compromised due to inefficiency and lack of accountability of low aid contractual staff.
(vii) Enhancement in contribution towards Group Insurance Scheme, is not justified as this would reduce the actual increase in take home salary considerably. If the rates are to be raised, the Government should bear the insurance premium
(viii) The recommendation regarding grant of only 80% of salary for the second year of Child Care Leave need not be accepted as this would deter women from availing of CCL, which was introduced as a welfare measure.
(ix) Annual increments be granted @ 5% instead of existing 3% and increments may be granted on two dates viz., 1 st of January and 1 st of July of every year as in the present system of grant of increment on 1 st July of every year, employees joining/promoted after 1 st January, who do not complete 6 months services as on 1 st July, have to wait for up to 18 months for grant of increment.
(x) The Commission’s recommendation of downgrading the Assistants of Central Secretariat for bringing in parity with their counterparts in the field offices is not appropriate.
(xi) Recommendation regarding PRIS need not be accepted as no scientific mechanism has been devised to assess the performance of employees and the same could e courage favoritism.
5. Issues regarding financ al upgradation under MACPS in promotional hierarchy without grading stipulation. grant of two increments on promotion introduction of Productivity Linked Bonus, treating Grameen Dak Sevak as Government employees, removal of pap of 5% on compassionate appointment 8i full pay and allowances In case of Work Related Illness and Injury Leave improving promotional avenues for technical and supervisory staff etc. were also raised by members of JCM.
6. During the discussion, representatives of JCM also suggested that the Nodal Officers nominated by various Ministries/Departments may hold interactions with recognized Staff Associations and other stakeholders under their purview so as to identify issues specific to those Ministries/Departments for redressal.
7. After hearing the participants, Cabinet Secretary observed that the deliberations have helped E-CoS in understanding the major concerns of the Staff-side and said that all issues have been taken note of. He assured that fair consideration will be given to all points brought out by JCM before taking a final view. He further stated that the E-CoS needs to examine the Report of the Commission in entirety as well as the issues raised by JCM in consultation with all other stakeholders. As such, it may take some time to take a final call on the recommendations of the Commission.
8. Cabinet Secretary also advised the members of E-CoS to hold interactions with their Staff Associations and other stakeholders under their purview preferably within a week.

Marvelous Biennial Divisional Conference of Rajkot division on Sunday 20th March

Marvelous Joint Biennial Divisional Conference of P3, P4 and GDS (NFPE) wings of Rajkot division was held on Sunday 20th March at a very well decorated and nicely arranged banquet hall at a reputed luxurious hotel. The real declaration of the program was more in presence of many retired and senior leaders of our federation. Com. K.B.Barot Ex.CS P3, Com. R. S. Malek Ex. CS P4, Com. Manubhai Parmar, Com. L. K. Chavda, Com. V. K. and several divisional leaders graced the occasion by their valuable presence and inspirational lectures. The conference was presided over by Com. S. T. Teraiya Vice President P4 (CHQ)

Com. Rahimbhai Makwana, Com. K. B. Chudasama & Com. Rajen Desani were unanimously elected as Divisional President, Secretary & Finance Secretary respectively. Com. Anil Joshi and Com. Damjibhai Chavda were elected as Divisional President and Secretary of P4 union. Com. Jayantibhai Sorathiya was elected as Divisional Secretary of GDS union. Circle union greets all office bearers for their unanimous election. Details of all newly elected office bearers of all wings will be posted on receipt of a list from division.

1.  Hours of business be restricted in all offices of division as per Directorate instructions.

2. No employee will now open RD accounts of small denominations from own pocket or by dividing a higher denomination account into many small denomination account. If any officer will force, circle Union will be immediately informed for trade union action.

B: It was requested by few staff members that there is no drinking water arrangement at so many offices in Surat dn. Off course, staff side is collecting specific details but it is requested to ensure that Clean, hygienic and cool drinking water arrangement is provided at all POs in Surat dn.

SURVEY OF CONDITIONS OF RENTED PO BUILDINGS AND UN-RESIDABLE POST ATTACHED QUARTERS IN VADODARA REGION.

Staff side has frequently taken up items in formal meetings regarding worst condition of rented PO buildings like of Ajwa road PO Vadodara. Staff side had supplied live reports and photographs also of many quarters in Bardoli & Valsad dn. which are not at all in any condition where any human being can reside. There has been a little response in this matter. It is suggested to conduct a survey of such PO buildings/Quarters for once and then initiate suitable action.

Subject: Court orders against Government of India instructions on service matters-consultation with Ministry of Law and Department of Personnel and Training on question of filing appeals.
The undersigned is directed to refer to this Department’s O.M.No.28027/9/99- Estt.(A) dated 1st May, 2000 on the above subject ( copy enclosed) and to say that the Department of Personnel and Training is the nodal Department that formulates policies on service matters and issues instructions from time to time. These instructions are to be followed by the Ministries/ Departments of the Central Government scrupulously. All the Court cases filed by employees have to be defended on the basis of the facts available with the Administrative Ministry/Department concerned, keeping in view the instructions issued on the subject by this Department.
2. Reference is also invited to the Cabinet Secretariat’s D.0 letter No. 6/1/1/94-Cab dated 25.02.1994 and the Department of Expenditure’s O.M. No. 7(8)/2012-E-II(A) dated 16.05.2012 inter-alia provide that (i) a common counter reply should be filed before a Court of Law on behalf of the Union of India by the concerned administrative Department/ Ministry where the petitioner is serving or has last served; and (ii) a unified stand should be adopted instead of bringing out each Department’s/Ministry’s point of view in the said reply. It further provides that it is primarily the responsibility of the Administrative Ministry to ensure that timely action is taken at each stage a Court case goes through and that a unified stand is adopted on behalf of Government of India at every such stage. In no case should the litigation be allowed to prolong to the extent that it results in contempt proceedings.
3. However, it is noticed that the Ministries/Departments are making several references to this Department seeking interpretation of the guidelines without exercising due diligence. The Ministries/Departments are advised not to make any references to this Department unless there are difficulties relating to interpretation/application of these guidelines or any relaxation in Rules/instructions is warranted to mitigate a genuine hardship faced the Government servant. While seeking advice of this Department, instructions contained in this Department’s O.M. number 43011/9/2014-Estt (D) dated 28.10.2015 may be followed.

Namaskar. Thanks for response, particularly because this is first ever response I got.
Kindly refer to my mail. We will be discussing on prima facie and large scale violation of policy guidelines of rotation of employees. The employees set in administrative offices are sticking there for decades without physical shifting. There are also CVC guidelines. No one can be indispensable. This is a major problem in entire region generally and Valsad dn particularly. This will be a point before Hon. PMG for general discussion.
I will attend on Friday 18th at about 11 am. Kindly inform Hon. PMG accordingly.

Circle union takes up again and seeks special meeting with Hon. PMG Vadodara for discussion on problems, discrimination and misuse of administrative powers at Valsad dn

Namaskar. please see attachment which is a letter received from Divisional Secretary AIPEUIII Valsad dn which is self explanatory.
Kindly recall our meeting at Navsari where I had discussed and represented regarding injustice and discrimination in dealing with Tithal BO fraud case in valsad dn. I have addressed 4-5 elaborated letters to your office by email as well as by post regarding mismanagement, favorism and misuse of administrative powers by ssp valsad.
Following questions are paining concerned victimised employees:
Why few of the subsidiary offenders and similarly situated employees are totally left and others are charge sheeted?
Why very big punishment to some and in  same to same cases moderate punishment to the other?
Why recovery of very huge monthly installment which leaves 2-4 thousand rupees only and how employees would maintain families?
Why one and same officials are continued as OA DO since decades by only paper transfer without physical shifting? Why no policy guide lines are not followed? We demanded many times that data of last 10 years of existing OAs may be reviewed and if they worked for most of period in DO their tenure may not be treated as broken and they may be shifted as per dte as well as CVC instructions.
Unfortunately my letters and mails are not seriously considered and no action has been taken and no response is received from your office.
I am also resending my previous emails for ready reference.
I request for granting a special informal meeting on this valsad matter as early as possible in which 3 representatives of valsad dn will also remain present.
I request Com. Harsh Purohit to print hard copy of this mail and send it to Hon. PMG Vadodara as well as Hon. SSP Valsad.

Namaskar. Here are few pics on the subject. We want to extend all possible cooperation and take the task on our hands for real work. Team is working quite voluntarily. We had been in front of thousands of people in shivaratri fair for 5 days from 8am to 1am midnight to popularise various schemes. From Monday we will sit in a pandal on gate of Indian Rayon Corporation Veraval to procure APY accounts of labourers as discussed with their management. We will sit for 3 days in Koli Samaj vadi at Sutrapada from Wednesday for 3days.

I afraid of only one thing sirs. In some divisions SPs are indirectly threatening staff by saying : " I will not force you to give Rs.10-15000. I will just see after 31 March who is with administration and who is against administration!" Rotation transfers are coming just after 31 March. Frightened staff gave 10000 or 15000 and opening 1000 or 1500 RD accounts of deno Rs.10 in single name and by using single passbook. Accounts are being opened in offices yet to be migrated. More than 1.5 lac such irregular accounts have been opened and till being opened. Some illegal software is also being used. If anybody will debit passbooks as per number of accounts and use only one, it would be very serious passage to fraud. I am more afraid by imaging that these offices will be migrated very shortly in CBS and at the time of its closure there will be intolerable load in closing these accounts. It will ruin manpower, time, energy and much more. Please, please and please sirs, immediately instruct all units to avoid such unnecessary work & illusive achievements. Particularly please instruct all units in Rajkot region. They are exaggerating.
I also urge for intimating action taken in GPO issue.

Khadi on Fridays for Central Government employees?

According to unconfirmed sources, the Centre is giving serious thoughts about making Khadi-wearing compulsory for its employees on Fridays. News continues to flow non-stop about Central Government employees and their offices the past few days. Recently, an order was issued making it mandatory to hoist the national flag atop the Kendriya Vidyalaya school buildings all over the country, everyday.
There are now plans of making the Central Government employees wear Khadi once every week, preferably on Fridays. All the Central Government employees – starting from the top bosses right down to the entry-level staff, will be asked to wear Khadi once a week. Saxena, the director of Khadi Gram Udyog, said that he was planning to discuss this possibility with the government soon. He however added that it wouldn’t be made mandatory, and will be left to the discretion of the employees.
According to sources, the officer also said that the sale of Khadi will increase tremendously if all the Central Government employees come forward to buy at least one dress and hoped that the employees wouldn’t oppose this.

NJCA STRIKE DATE & STRIKE NOTICE SERVING DATE POSTPONED

 Taking into consideration the request of the Cabinet Secretary to give more time to Govt to arrive at conclusions on the Charter of demands raised by Staffside and also the situation in the aftermath of the coming into effect the Election Code of Conduct NJCA meeting held on 7th March decided to defer the date of commencement of indefinite strike to 11th July 2016 and to serve strike notice on 9th June 2016. Detailed mobilisation programme will be announced later =

Centre decides to withdraw tax on Provident Fund


News have surfaced that the Prime Minister has instructed the Finance Minister to put a hold on the proposed plan to impose taxes on PF withdrawals. Finance Minister Arun Jaitley is expected to make an official announcement in this regard shortly.
Employee unions all over the country have been vehemently opposing the proposed tax on the withdrawals made on the most important savings of a worker, from the moment the announcement was made. Most employees depend on their provident fund savings to meet some of the most important expenses of their lives, like medical, marriages, building a house, etc. The decision to impose tax on these withdrawals was condemned by all.
Jaitley had announced a tax on 60 percent of the Employee Provident Fund, and Public Provident Fund. The government has now said that they had planned to impose tax only on the PF Interest. But, there was strong opposition for this too. Demands were made to withdraw this tax.
According to information available, Jaitley had informed at the meeting of the MPs that the Prime Minister will have to decide on this. Meanwhile, the Prime Minister has recommended the Finance Minister to stop the tax on the PF withdrawals, and to conduct a thorough study on this. Arun Jaitley is expected to take the required action after consulting with the officials of his ministry. The Prime Minister’s intervention has restored the peace of mind of more than 60 lakh Government employees.

Recovery of wrongful and excess payments made to Government servants – Dopt orders on 2.3.2016

OFFICE MEMORANDUM
Sub: Recovery of wrongful / excess payments made to Government servants.
The undersigned is directed to refer to this Department’s OM No.18/26/2011-Estt (Pay-I) dated 6th February, 2014 wherein certain instructions have been issued to deal with the issue of recovery of wrongful / excess payments made to Government servants in view of the law declared by Courts, particularly, in the case of Chandi Prasad Uniyal And Ors. vs. State of Uttarakhand And Ors., 2012 AIR SCW 4742, (2012) 8 SCC 417. Para 3(iv) of the OM inter-alia provides that recovery should be made in all cases of overpayment barring few exceptions of extreme hardships.
2. The issue has subsequently come up for consideration before the Hon’ble Supreme Court in the case of State of Punjab & Ors vs Rafiq Masih (White Washer) etc in CA No.11527 of 2014 (Arising out of SLP(C) No.11684 of 2012) wherein Hon’ble Court on 18.12.2014 decided a bunch of cases in which monetary benefits were given to employees in excess of their entitlement due to unintentional mistakes committed by the concerned competent authorities, in determining the emoluments payable to them, and the employees were not guilty of furnishing any incorrect information / misrepresentation / fraud, which had led the concerned competent authorities to commit the mistake of making the higher payment to the employees. The employees were as innocent as their employers in the wrongful determination of their inflated emoluments. The Hon’ble Supreme Court in its judgment dated 18 th December, 2014 ibid has, inter-alia, observed as under:
“7. Having examined a number of judgments rendered by this Court, we are of the view, that orders passed by the employer seeking recovery of monetary benefits wrongly extended to employees, can only be interfered with, in cases where such recovery would result in a hardship of a nature, which would far outweigh, the equitable balance of the employer’s right to recover. In other words, interference would be called for, only in such cases where, it would be iniquitous to recover the payment made. In order to ascertain the parameters of the above consideration, and the test to be applied, reference needs to be made to situations when this Court exempted employees from such recovery, even in exercise of its jurisdiction under Article 142 of the Constitution of India. Repeated exercise of such power, “for doing complete justice in any cause” would establish that the recovery being effected was iniquitous, and therefore, arbitrary. And accordingly, the interference at the hands of this Court.”
“10. In view of the afore-stated constitutional mandate, equity and good conscience, in the matter of livelihood of the people of this country, has to be the basis of all governmental actions. An action of the State, ordering a recovery from an employee, would be in order, so long as it is not rendered iniquitous to the extent, that the action of recovery would be more unfair, more wrongful,
more improper, and more unwarranted, than the corresponding right of the employer, to recover the amount. Or in other words, till such time as the recovery would have a harsh and arbitrary effect on the employee, it would be permissible in law. Orders passed in given situations repeatedly, even in exercise of the power vested in this Court under Article 142 of the Constitution of India, will disclose the parameters of the realm of an action of recovery (of an excess amount paid to an employee) which would breach the obligations of the State, to citizens of this country, and render the action arbitrary, and therefore, violative of the mandate contained in Article 14 of the Constitution of India.”
3. The issue that was required to be adjudicated by the Hon’ble Supreme Court was whether all the private respondents, against whom an order-of recovery (of the excess amount) has been made, should be exempted in law, from the reimbursement of the same to the employer. For the applicability of the instant order, and the conclusions recorded by them thereinafter, the ingredients depicted in paras 2&3 of the judgment are essentially indispensable.
4. The Hon’ble Supreme Court while observing that it is not possible to postulate all situations of hardship which would govern employees on the issue of recovery, where payments have mistakenly been made by the employer, in excess of their entitlement has summarized the following few situations, wherein recoveries by the employers would be impermissible in law:-
(i) Recovery from employees belonging to Class-III and Class-IV service (or Group ‘C’ and Group ‘D’ service).
(ii) Recovery from retired employees, or employees who are due to retire within one year, of the order of recovery.
(iii) Recovery from employees, when the excess payment has been made for a period in excess of five years, before the order of recovery is issued.
(iv) Recovery in cases where an employee has wrongfully been required to discharge duties of a higher post, and has been paid accordingly, even though he should have rightfully been required to work against an inferior post.
(v) In any other case, where the Court arrives at the conclusion, that recovery if made from the employee, would be iniquitous or harsh or arbitrary to such an extent, as would far outweigh the equitable balance of the employer’s right to recover.
5. The matter has, consequently, been examined in consultation with the Department of Expenditure and the Department of Legal Affairs. The Ministries / Departments are advised to deal with the issue of wrongful / excess payments made to Government servants in accordance with above decision of the Hon’ble Supreme Court in CA No.11527 of 2014 (arising out of SLP (C) No.11684 of 2012) in State of Punjab and others etc vs Rafiq Masih (White Washer) etc. However, wherever the waiver of recovery in the above-mentioned situations is considered, the same may be allowed with the express approval of Department of Expenditure in terms of this Department’s OM No.18/26/2011-Estt (Pay-I) dated 6th February, 2014.
6. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

GET READY FOR INDEFINITE STRIKE FROM 11th APRIL-2016


            The 7th Central Pay Commission has submitted its report to Government of India. The recommendations given by the Pay Commission are most retrograde. The Chairman, Pay Commission did not consider even a single demand of unions. The demand of minimum wage as per Dr. Aykhroyid formula has been negated totally. The National Council JCM demandedminimum wage as Rs. 26000/- but the Pay Commission has recommended only Rs. 18000/-.Other demands  like rate of increment  as 5% , upgraded  pay  scales to the various cadres of Postal Department , 5 promotions , Deletion of Bench Mark  in MACP, Revision of wages  and other service conditions  of GDS ,wage revision of Casual part time  and contingent employees, cashless   hassle free Medical   facility , One time LTC to visit abroad, Removal of ceiling of 5% on compassionate  appointments, Scrapping of New Pension Scheme , 67% of pay as pension  on superannuation  along with other  demands have not been considered .Beside this the Pay Commission has  recommended to abolish  52 existing  allowances and advances like HBA, Festival Advance , TA Advance and Medical Advance. The percentage of HRA has been reduced as 24%, 16%, 8% instead of 30%, 20% & 10%.

            This Pay Commission is one of the worst Pay Commission ever seen. It has recommended only 14.29% increase like 2nd Pay Commission.

            The NJCA after  detailed  discussions in  several Meetings with all constituents organizations  of National Council  JCM  has submitted  memorandum and Charter of demands to the Government  of India with the warning  that if the same  is not settled , NJCA (Railway, Defence, Confederation) will  be  forced  to go on indefinite strike  from 11th April -2016 for which the notice will be served  to Cabinet  Secretary  along with all heads of departments and at all levels on 11th March, 2016.

            The Government has set up implementation Cell in Finance Ministry which will work as Secretariat to Empowered Committee headed by Cabinet Secretary for processing and implementation of recommendations of 7th Pay Commission. First meeting has been taken by the Chairman implementation Cell with NJCA leaders on 19th February, 2016. NJCA leaders have very clearly told that Employees will go on indefinite strike from 11th April, 2016.

            The Confederation of Central Government Employees and Workers and national Federation of Postal Employees along with Postal JCA have endorsed the decision of NJCA.
            All Central leaders will address rallies in the Capital Cities to popularize the strike demands and to mobilize the employees for which campaign programme has been chalked out and circulated among all.

            29th March -2016 will be observed as Solidarity day throughout the country by all constituents of NJCA.

            We as NFPE being on the forefront of all struggles have more responsibility to carry on all agitational programmes more successfully.

            Keeping in view all the above mentioned facts NFPE appeals to the entirety of Postal, RMS and GDS employees to make all the agitational programmes  cent per cent success and make all efforts to make the indefinite strike  from 11thApril-2016 a historic success to achieve the genuine  and justified demands.

We have won on so many occasions and this time also we will win.
