Today, Bimonthly meeting at R.O. Rajkot. All NFPE CS will also meet for deciding campaign program for GDS verification of memberships

After 13 Months, Bimonthly meeting has been convened at R. O. Rajkot. Staff side has frequently, by letters and items at Circle level formal meetings, conveyed resentment against such slackness and reluctant approach of R.O.  Rajkot Administration.

NFPE & FNPO leaders will jointly convey their strong protest by shouting slogans in front of the regional administration. 

Today, all CS and frontline leaders of NFPE  unions will also meet and discuss to carry on responsibility, on top priority as per directives of NFPE HQ, for ensuring maximum membership of GDS in the coming verification process.

All DS may now please wake up and involve themselves in this very urgent requirements of the time.

GDS MEMBERSHIP VERIFICATION
OUR RESPONSIBILITIES AND IMMEDIATE TASK  ELECT AND SELECT AIPEU-GDS AS THE ONLY ONE RECOGNISED GDS UNION
Dear Comrades,
                   As all of you are aware Department of Posts has commenced the process of verification of membership of Gramin Dak Sevaks for grant of recognition.  The AIPEU-GDS was formed in the year 2012 and the Federal Council of NFPE held at Hyderabad in 2013, which is the highest decision and policy making body of NFPE, has decided to grant  “Associate Membership” to the newly formed AIPEU-GDS.  For the last four years, AIPEU-GDS is functioning without recognition and joined all the programmes of NFPE including strike.  During this four year period it had conducted two All India Conferences and formed Branches in all the 22 Circles.  After formation of AIPEU-GDS, it is the first membership verification taking place.
                   There is no doubt that the AIPEU-GDS will get recognition and shall become number one recognised GDS Union, with flying colours.  But that is not enough - we should make the AIPEU-GDS as the only one recognised GDS Union in the Department of Posts.  It is not impossible.
                   For fulfilling the above task, all Circle/Divisional Branches of NFPE affiliated Unions/Associations and also all CHQ office bearers are hereby requested to take immediate action to implement the following directions of NFPE.
1.                It should be ensured that Circle/Divisional Unions of AIPEU-GDS is formed in all Circles/Divisions.
2.                The name, designation and official address of the Circle/Divisional Secretaries should be intimated to “Com.P.Panduranga Rao, General Secretary, AIPEU-GDS, 1, Patel Road, Shadipur, Dada Ghosh Bhavan PO, New Delhi-110 008”.  Email ID: aipeugdsnfpe@gmail.com  Mob: 09849466595.  Divisional Secretaries should inform the above particulars to Circle Secretaries also.
3.                Still there are some divisions where the branches of AIPEU-GDS are not yet formed, inspite of repeated instructions from NFPE.   All those Divisions where the branch of AIPEU-GDS is not yet formed should form the Branch Union or at least an Adhoc Committee at Divisional level with a Secretary or Convenor before 15th April 2016.  The name, designation and official address with pin code and mobile number of the newly elected Secretary or Adhoc Committee Convenor should be intimated to the General Secretary and Circle Secretary.  Wherever Circle Unions are not functioning immediate action should be taken to form a functioning Circle Union or Circle level Adhoc Committee of AIPEU-GDS.
4.                It is reported from some circles that some P3 and P4 Divisional Unions of NFPE has not taken any positive action to form the Divisional Branches of AIPEU-GDS.  Not only that in some limited divisions, the rival GDS Union, which is campaigning against NFPE and has formed separate unions for Group-C and Postmen/MTS in the name of “UNITED” to break our P3 and P4 Union and thereby to destabilise NFPE, is given all help and assistance by the some P3 and P4 Unions of NFPE and also holding joint meetings with the rival GDS Union which is no more an affiliate or Associate of NFPE.  This is not permissile and is in violation of the directions and guidelines issued by NFPE.  It is once again made clear that disciplinary action will be taken against those divisions which refuse to form the branches of AIPEU-GDS and which are still cooperating and extending all help to the rival GDS Union and conducting joint meetings.  The recognition of all such Divisional Unions which refuse to carry out the directions of NFPE will be withdrawn without any further notice.
5.                Last date for submission of application by GDS Unions for participating in the membership verification process is 31-03-2016.  AIPEU-GDS has already submitted application to the Directorate on 18-03-2016.  Please note that the name of our union is “AIPEU-GDS”.  Department may issue orders fixing the last date for submission of authorisation forms to the Divisional heads, along with the model authorisation form with the signature of an officer of the Directorate.  Immediately on publishing the authorisation form by the department all the affiliated unions of NFPE should jointly jump into action and collect maximum number of authorisation forms from GDS of each division.  As GDS are working in remote villages, action plan should be chalked out now itself, for visiting each and every Branch Post Office by the NFPE leadership, for collecting authorisation forms signed by the GDS in favour of AIPEU-GDS.
6.                AIPEU-GDS is the GDS Union of NFPE and it is the collective responsibility of all Circle/Divisional Unions of NFPE to make our GDS Union as the only one recognised union.  Let us take it as a challenge and prove that it is possible.
7.                A separate circular issued by AIPEU-GDS CHQ is also enclosed herewith.

7th CPC – Expectations run high for the implementation of the Pay Commission…


After the recommendations of the 7th CPC were submitted to the Union Government on 19th November 2015, the news about its implementation was eagerly awaited by the central government employees. Before the submission of the recommendations, the Union Government indicated that the implementation of the 7th CPC will be done from the 1st of January 2016 itself and there will be no question of arrears payment. Instead of that, the government formed an Empowered Committee to analyze the recommendations and extended another four months for the detailed study of it. After the extension, everyone expected, the government will publish the notifications in April 2016. But that was also not happened as the Assembly Elections to five states were announced and now, everyone expects the implementation will take place after the results of the elections.

Now-a-days, the main attraction on the social media is the news about 7th CPC. But there are conflicting reports about the date of implementation of the Pay Commission. Some says, it is from June 2016 and some say, it is from September 2016. But there is no authenticity in these reports.

But for the employees are concerned, they expect an early implementation of the pay commission. They think that the union government is purposely delaying the notifications for the sake of saving money in the form of allowances like HRA and TA which are not calculated in the arrears to be paid to the employees. In the 6th CPC, the same had happened, as there were no arrears paid for the allowances from January 2006 to August 2008, the date of implementation of the Pay Commission.

Now, the Union Government should explain the reasons for the abnormal delay in publishing the notification. As the elections for the states are the main reason, there is no violation of the code of conduct, and permission can be obtained from the Election Commission for the implementation of the 7th Central Pay Commission. It is expected that the government publish the notification after the results of the assembly elections, the Cabinet will pass the bill in July 2016.

MEMORANDUM

FOR JUSTICE BY CAUSING PROMPT INVESTIGATION TO ENSURE SEGGREGATION OF TAINTED AND UNTAINTED INCUMBENTS OF POSTAL/SORTING ASSISTANTS, ACCEPT VERDICT OF HON. C.A.T. AHMEDABAD & OTHER TRIBUNALS WITHOUT APPEALING IN HIGH COURTS AND CONDITIONAL REINSTATEMENT IN JOB DURING PENDENCY OF INVESTIGATION CONSIDERING ACUTE & UNMANAGEABLE SHORTAGE OF STAFF IN DEPARTMENT OF POSTS.

Hon’ble Sir,

Namaskar. Respectful regards. Candidates were appointed in the PA/SA cadre in the Direct Recruitment Process for the year 2013-14 were taken on job after observing all pre-appointment formalities and Induction training.  The process of Pre-appointment formalities was held in abeyance subsequently and therefore many of selected candidates have been waiting for their appointment. On receipt of some complaints regarding irregularities in the recruitment process, vigilance Investigation was conducted and finally the Chief Postmaster General was informed by the Director General vide letter No. A-34013/05/2014-DE (Chapter-II) dated 11.12.2015 that “ the competent authority has ordered to cancel the PA/SA Direct Recruitment Examination 2013-2014. Accordingly the CPMG Gujarat Circle had issued an order dated 23-12-2015 by which the result of examination for direct recruitment of PA/SA for the year 2013 &2014 have been cancelled and therefore services of all candidates were terminated by the concerned Divisional authorities. Obviously, all other candidates who were waiting for their appointment have also been informed of the above orders.

Aggrieved by said orders and resultant termination from service, they approached Hon. C.A.T. Ahmedabad and a verdict has been delivered by a common order dated 21st March 2016, with reference to cases of terminated employees. Hon. C.A.T. has quashed above said orders of the Director General dated 11.12.15 in so far as the same relates to Gujarat circle and also quashed orders dated 23.12.15 by which services of the employees were terminated by the Sr/Superintendents of different divisions in Gujarat Postal Circle.

The similar verdict has been given by Hon. C.A.T. Ahmedabad in its order dated 30th March 2016 in respect of cases of the candidates whose appointment was held in abeyance and who suffered similar injustice by orders of the Director General dated 11.12.15 and resultant orders of concerned Sr/Superintendents dated 23.12.15.

Hon. C.A.T. has further ordered to keep Select list in abeyance and directed respondent authorities to probe into the matter by thorough investigation in a fair and transparent manner to be undertaken by Vigilance Wing of the department or by any other suitable Investigating Agency within a period of 3 months and unearth the scam. It has also been ordered that: “depending upon the outcome of the probe, the respondents shall take appropriate decision relating to operation of the select list in the light of the decisions of Hon’ble Supreme Court in the case of Inderpreet Singh Kahlon v. State of Punjab (2006) 11 SCC 356 and Joginder Pal & Others (2014) 6 SCC 644. Hon. C.A.T. has clearly mentioned in the said order that it decline to grant the relief of reinstatement into service for the reason that there are specific allegations against 34 specified candidates in the complaint received by the P.G. Cell on 09-04-2014. None of the selected candidates pleads guilty. As such it is difficult to ascertain who are the 34 amongst the selected/appointed. The possibility that all the 34 or some amongst them have been already appointed cannot be overruled. Such tainted, unscrupulous candidates who are responsible for the present crisis deserve to be seriously dealt with in accordance with law. Hence, we hold that the applicants are not entitled for reinstatement into service till such time the respondents complete the exercise ordered hereinabove”.     

Sir, it has become a very clear picture from above verdict that there is a list of 34 tainted candidates and it has to be ascertain as to who are they amongst selected/appointed. An investigation has to be carried out by the Vigilance Wing of the department or by any other suitable Investigation Agency within a period of 3 months to unearth the scam and identify tainted candidates. Future of innocent employees lies upon outcome of the said investigation. They are afraid that the department will till avoid investigation and challenge the decision of Hon. C.A.T. Ahmedabad in Hon. High Court. It will be very difficult, costly and shocking for poor and jobless candidates to deal cases in the higher judiciary forums. We understand that each department has its own policy and strategy to follow the legal advisories. At the same time we humbly pray your honour to consider to accept a verdict for conducting thorough investigation. Sir, your honour will also agree that it is very painful when hundreds of innocent incumbents are thrown away from job by a single stroke of pen only because of few tainted persons. 

Sir, our basic concept of jurisprudence is that the 100 culprits may let go free but no innocent should be punished. Quite contrary to this concept, hundreds of innocents are suffering because of few tainted persons. Therefore we urge your honour to kindly accept verdict of Hon. C.A.T. Ahmedabad and please consider that candidates are coming from poor/middle class families and there will be huge expenditure of lacs of rupees from their pocket if they are compelled to face the case in the higher judiciary forum like HC.

We also urge to consider possibility for conditional reinstatement of these candodates in service as PA/SA even on outsourced basis subject to outcome of the investigation which may be conducted as per direction of Hon. C.A.T. 

At present, DOP is facing problems of acute shortage of staff and slack working of finical in CBS offices and there are many news reports about chaos and agitation by customers. Conditional reinstatement or services at outsourced basis would definitely help in resolution of all problems due to shortage of staff in general and skilled young staffs in particular.

Thus, we repeat to narrate our humble urge with folded hands as under:

To accept verdict of Hon. C.A.T. Ahmedabad and cause investigation to segregate tainted and untainted candidates and impart justice to innocent incumbents.

To avoid challenge decision of Hon. C.A.T. in Hon. High Court considering as to what is wrong in complying with direction for conducting investigation and thereby obliging jobless innocent youth by savings of huge expenditures for facing court cases and payment of fees etc.

To take them on job conditionally, subject to outcome of investigation, or even on outsourced basis by taking any binding in writing from them.

Government To Recruit 2.2 Lakh Central Govt Employees In Two Years


Central government is set to recruit 2.2 lakh central government employees over a period of two years from March 1, 2015, despite the Centre’s announcements from time to time on a freeze in fresh recruitments.
The central government’s actual staff on March 1, 2015 was 33.05 lakh, which increased to 34.93 lakh in 2016 and is estimated to grow to 35.23 lakh by March 1, 2017, according to the budget estimates for 2016-17.
This includes the railways — which has not added a single worker to its strength of 13,26,437 in the last three years — but excludes the defence forces.
The biggest increase of 70,000 is projected in the revenue department which comprises income tax and customs, central excise and service tax, followed by central paramilitary forces, projected to rise by 47,000. The strength of the home ministry, excluding paramilitary forces, has increased by 6,000.
The cabinet secretariat, a fairly small department assisting the government, will add 301 employees, going up from 900 in 2015 to 1,201 by March 1, 2017. The I&B ministry added nearly 2,200 personnel in the last two years.
The personnel ministry, which manages government staff, added 1,800 jobs in the last two years, the urban development ministry 6,000, mines ministry 4,399 and department of space 1,000.
However, the financial allocation for salaries and allowances for the revenue department has not shown any major difference, for the reason that the department has not been able to recruit personnel due to slow progress in the cadre restructuring exercise.
Some departments have faced downsizing. Interestingly, there has been a cut in the department of rural development, the focus area of the government, where the strength has come down from 538 in 2015 to 472 in 2016-17.
A major reason for the spurt in hiring is that many departments faced acute staff crunch in Group B and C categories due to a moratorium on fresh recruitments for the past several years.
A lot of the new appointments have been in these categories. Vacancies have piled up over the years. More than six lakh posts are vacant in various central government ministries, according to the personnel ministry.

Circle Secretary seeks termination of Deputation at PSD Ahmedabad

Request for termination of deputation (Temporary transfer) at PSD Ahmedabad with immediate effect.


Respected Sir,
Namaskar. Being Circle Secretary of NFPE Gr.C union, I am working as OA PSD, Ahmedabad, on grounds of immunity from transfer, on deputation basis which was extended at each six month's periods. I convey gratitude for co operation given up till now. Now 4 years have been completed at PSD Ahmedabad and I assume that policy for rotation apply equally to me. On other hand, due to 50% visual disability & inability to work on computer & statistical work, I cannot work in any other PO at Circle HQ. Once, a break is taken, I can urge posting again at PSD itself on same grounds of immunity from transfer. Therefore, I have decided to seek immediate termination of deputation.


I am working at Junagadh on special duty wef 1-3-16 in connection with BD work especially for SSY/APY accounts. I therefore request to issue order regarding termination of my deputation at PSD Ahmedabad with immediate effect and continue at Junagadh on expiry of present deputation at Junagadh.

I request to kindly not to delay and send orders by email.

Respected sir,
Namaskar. Staff side conveys grief and plain hearted protest against deliberate, abnormal, vindictive, humiliating and unconvincing delay in holding bimonthly meetings at intervals of more than one year as a routine and also against inaction and nonresponse to memorandums submitted in previous meetings. If meetings due bimonthly are convened yearly and no action on representations of staff side is taken and no entity of staff unions is recognized, there is obvious neglect and mockery of trade Union forums and  there will be no purposeful meaning for submitting any items for agenda. With this protest, staff side submits no new items.

Staff side will definitely orally discuss on above points and on previously submitted memorandums.

Revised rates of Allowances can be included in 7th Pay Commission Arrears calculation?
The Central Government employees know the fact from their past experience that the Allowances will not be given retrospective effect whenever it is got implemented. In Previous Pay Commissions, the increased amount in Allowances like HRA and TA will not be added in the Arrears because all the revised rates of Allowances are paid with effect from the date of Notification issued.
If the Notification issued on 1st July 2016, it is not sure whether the government will implement the revised rate of Allowance from January 2016. The Central Staffs will be at loss of six Months Arrears in respect of revised rates of Allowances if it is implemented with effect from the date of issue of Notification. Difference in the Basic Pay alone will be paid as Arrears. Finally, the period of delay in issuing Notification will make the CG Employees lose their increased amount in Allowance for that particular period.
It is upto the bargaining power of Government and Federations that decides the effective date for payment of Revised Allowances
It is therefore, now the expectation of central government employees focused especially on date of Notification and amount of Arrears they will be getting after the implementation of 7th pay commission. They now started calculating the 7th pay commission arrears. Until now it is not clear that when will the notification be issued for implementation of pay panel report.
