OFFICE MEMORANDUM

Subject: Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2014.

The undersigned is directed to refer to this Ministry’s Office Memorandum No.I-8/2013-E-II (B) dated 25th September, 2013 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 90% to 100% with effect from January, 2014.

2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No.1(3)/2008-E-11(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

4. The payment of arrears of Dearness Allowance shall not he made before the date of disbursement of salary of March. 2014.

5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will he issued by the Ministry of Defence and Ministry of Railways, respectively.

6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Four monthly meeting at C.O. on 24th March 2014

It was a routine formal meeting on items of Agendas published earlier.

The minutes will be posted as and when received.

Several issues were informally discussed and  approach of our Chief PMG was very positive and judicious.

While discussing about forced trainings and meetings on Sundays and Holidays, staff side expressed thanks for cancelling such meetings in previous week responding our email. In this matter he asked PMG Rajkot on the spot to let staff enjoy Sundays and Holidays with their families. Approach of SP Jamnagar was also discussed, who reported to Circle office that all GDS staff is willingly ready to attend meetings and meals on Sundays and Holidays!! CPMG also commented that it is not convincing. Even if few persons show readiness, how decisions can be applied to all? Staff side was satisfied with response given by CPMG.

Issue of local purchase of stationary and allied matters was also discussed. 

Some minor issues like pending approval for purchase of printers at BK Dn, force to prepare manual PA17 etc were also discussed.

It was importantly discussed about relief arrangement of officials whose approval and posting orders already issued two years or more back. It was clearly ordered that they will be relieved after recruitment of 2011-12 but till this date divisional and regional heads are submitting plea of shortage on retirement or promotions etc. Staff side urged to consider that if once they are relieved, vacancies would be calculated for next recruitment. If some result oriented action is not taken, so many PAs will remain awaiting their relief all the time and years together. Our CPMG assured to streamline processes and cause relief arrangements shortly.

Dear Comrades,
                 
As already mentioned in the last month’s “General Secretary’s Desk” a Special Convention and Workshop of all Circle Secretaries and Divisional/Branch Secretaries of AIPEU Group-C will be held on 2014 May 26th & 27th (Monday, Tuesday) at Shah Auditorium, New Delhi, exclusively to discuss the P-3 specific issues and for preperation of the draft memorandum of AIPEU Group-C (CHQ) to be submitted to the 7th Central Pay Commission.  The draft memorandum prepared in the workshop will be placed in the website and also before the Central Working Committee of AIPEU Group-C (CHQ) to be held in August 2014 in Andhra Pradesh Circle, for final approval.

All Circle/Divisional Secretaries of AIPEU Group-C are requested to attend the convention and Workshop WITHOUT FAIL.  If any Circle/Divisional/Branch Secretary cannot attend due to unavoidable circumstances, one representative should be deputed on behalf of Divisional / Branch/ Circle Union.  Limited number of special visitors will also be allowed to attend.  Please book your tickets well in advance.  Please convene your Divisional/Branch/Circle Working Committees/Circle Councils before coming to Delhi and discuss and finalise all P-3 specific points to be included in the 7th CPC Memorandum in a most democratic and transparent manner.  Suggestions should be the outcome of collective discussion and collective wisdom. Active involvement of rank and file members may also be ensured in the process.

DELEGATE FEE:

As CHQ is holding the Special Convention and Workshop at New Delhi itself it is decided to fix delegate fee of Rs.700/- (Rs. Seven hundred only) per head.  Food (only lunch and Tea) and accommodation (hall with floor beddings and bath room facilities) will be provided by CHQ.  Delegate fee is reduced from Rs.1,000/- to Rs.700/- as the Breakfast and Dinner is not arranged by CHQ.  Convention will be from 11 AM to 7 PM on both days.  The rent of the AC Auditorium for two days itself comes to Rs. One Lakh Twenty Thousand (Rs.1,20,000).  AC is required as May is the hottest season in Delhi.  Draft memorandum prepared by CHQ will be supplied in the convention/workshop along with file.

Total Expenditure may come to Rs. 4,50,000/- (Rs. Four Lakh Fifty Thousand only) NO DELEGATE WILL BE ALLOWED TO PARTICIPATE IN THE CONVENTION/WORKSHOP WITHOUT PAYING DELEGATE FEE. THIS WILL BE STRICTLY IMPLEMENTED.

IMPORTANT

All CHQ Office Bearers and Circle Secretaries who are attending the 4th April 2014 Nagpur Confederation National Convention and also the 26th & 27th May, 2014 Delhi Convention and Workshop on 7th CPC P-3 specific Memorandum are requested to bear their TA/DA from their respective Circle Unions.  As the CWC is to be held in the month of August 2014 in Andhra Pradesh Circle and again in November 2014 at Jamnagar (Gujarat) in connection with the final ceremony of NFPE Diamond Jubilee Celebrations,  we have to pay the TA/DA to all office bearers and Circle Secretaries (CWC members) attending the CWC.  Paying TA/DA for Nagpur and Delhi conventions also will result in huge expenditure for the CHQ.  All CHQ office bearers and Circle Secretaries are requested to co-operate and bear with the CHQ.

CIRCLE/DIVISIONAL/BRANCH SECRETARIES - YOUR ATTENTION PLEASE:

As we have to devote full two days for discussion and preparation of P-3 memorandum to be submitted to 7th CPC, we will not be getting any time to discuss the pending problems of Circle/Divisional/Branch Unions.  Hence there will not be any discussion on Circle/Divisional/Branch level pending issues in the Special Convention & Workshop.  However the CHQ want to consolidate all pending problems of Circles/Divisions (other than Pay Commission related issues) and the General Secretary will explain the position of each case in the Special Convention/Workshop.

In order to facilitate the CHQ to consolidate and reply the position / action taken in respect of all the important pending issues in the Convention/Workshop, all Circle/Divisional/Branch Secretaries are requested to fill up the enclosed Proforma-I and send it to the CHQ on or before 30th April, 2014.  Please ensure that the report is sent before the cut-off date without fail, ie. before 30-04-2014.  Please fill up Proforma-II also and send it before 30-4-2014, so that CHQ can provide accommodation only for those delegates who actually want it.  It is presumed that many delegates may hire hotel accommodation at their own cost.

ENROL NEW MEMBERS IN THE MONTH OF APRIL, 2014.

In some circles, in each Division, there are employees who are not yet enrolled as members in any union (Non-members).  Similarly some employees from other unions may be willing to join our Union.  Further many new-recruits who joined the department are yet to be enrolled as members under check-off system (Recovery of subscription from pay-roll).  All the above categories of employees are to be enrolled in the membership of AIPEU Group-C in the month of April.  All Divisional/Branch Secretaries and Circle Secretaries are requested to make a special drive to collect the declaration from all non-members in April, 2014.  Declaration should be submitted in the same proforma submitted at the time of membership verification.  Signature of Director (SR) not required.  No other change.  Modified order of Directorate already cancelled and old order stands.  White paper application not enough.  It should be in the proforma itself.  Please note.

Homage to Late. Shri. Himanshu D. Pandya

Our Regards to Late. Shri. Himanshu D Pandya Ex.ASP Junagadh on his first Death anniversary. He was totally pias, strong and the most beloved officer who always stood fearlessly against corruption and misuse of powers. He frequently imparted most useful advise and information to our union. Though he was officer, he made so many correspondence with circle union as well as our General Secretary against forced trainings and meetings on Sundays and Holidays, regarding residual vacancies in PA cadre and on so many burning issues. We really lost a friend, Philosopher and Guide. We salute him. He is chiranjivi for all of us.

CONFEDERATION NATIONAL SECRETARIAT CALLS UPON THE ENTIRE CG EMPLOYEES TO PROTEST AGAINST THE ARBITRARY AND UNILATERAL DECISION OF THE GOVERNMENT.

Dear Comrades,

The Union Cabinet approved the Finance Ministry’s proposal on terms of reference of the 7th CPC.  We have placed the full text of the same on our website.  None of the suggestions made by the Staff Side was accepted by the Government.

However, our concern over the date of effect seems to have been taken note of.  The terms of reference has left the effective date of its recommendations to be decided by the Commission itself.  A united stand backed up by struggles will enable us to clinch this demand in our favour.  Undoubtedly it has been our endeavours and the two days strike action that has compelled the Government to have a rethinking on their earlier stand of Decennial (Ten years} wage revision for Central Government employees and the date of effect as 1/1/2016

Unlike on the earlier occasion, the Government has not decided to grant Interim Relief and merger of Dearness allowance.  Nor has it asked the Commission to consider and make appropriate recommendation in this regard specifically.  As pointed out in our earlier communication, inclusion of a labour representative in the Commission being not an idea the UPA Government cherishes, for it is diametrically opposite to its economic policies and ideology, they have stuck to the position of sandwiching the Honourable Judge with bureaucrats.  In the light of the agreement penned by Com. Mahadeviah, the General Secretary of the recognised GDS union with the Postal Board to the effect that a separate one man committee will look into the service conditions of the Grameen Dak Sewaks, it is not surprising that the Government chose to ignore our demand to cover them within the ambit of the 7th CPC.   Our demands for parity between the past and present pensioners and scrapping of the new pension scheme also stand rejected.

As you are aware, the 6th CPC (and the earlier Commissions also) had refused to entertain the demand for removal of anomalies despite Government referring the same to the Commission specifically.  Therefore, the omnibus clause in the terms of reference requiring the Commission to submit interim reports may not be of any help to us to raise the anomalies before the 7th CPC.

At the conclusion of the meeting held on 24/10/2013 by Secretary, DoPT, with the staff side on terms of reference of the 7th CPC, it was agreed that the Government will consider our suggestion in the matter and will convene another meeting with the presence of Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter. But no such meeting was convened and no attempt was made by the official side to arrive at an agreed Terms of Reference.

We must now react to the arbitrary and unilateral decision of the Government.  We appeal all the State Secretaries, District Secretaries and Branch Secretaries of the affiliated organisations and the State/District COCs to immediately send the following Savingram to the Prime Minister.

(i)            Interim Relief
(ii)          Merger of DA
(iii)         Bringing the Grameen Dak Sewaks within the ambit of the 7th CPC
(iv)         Date of effect from 1/1/2014
(v)          Parity in pension entitlement between the past and present pensioners
(vi)         Coverage of the existing defined benefit pension scheme to employees recruited on or after 1.1.2004.
(vii)       Include a representative of the Labour in the 7th Central Pay Commission.
(viii)     Settle the anomalies raised in the National Anomaly Committee

While the National Convention scheduled to be held at Nagpur will chalk out detailed and phased programmes of action, we call upon our State Committees and Affiliated Unions to organise massive demonstration in front of all offices and important centres on 7th  March, 2014 (Friday) or any other immediate convenient date. Kindly instruct all the Branches to mobilise their members so that the demonstration has the participation of cent per cent of the membership of the concerned branch.  The State Units and affiliated Unions may issue pamphlets and posters and ensure its wide circulation throughout the country.

As already declared by the National Secretariat of the Confederation, we shall have to go for an indefinite strike action immediately after the General Election if our demands are to be settled.

Modest Expectation for 50% DA Merger still on the cards
The expectations will not subside until the central government makes it clear whether 50% DA Merger will be approved or not. Though there were mixed news about whether 50% DA Merger is approved or not, Railway and Defence Federation’s Leaders told that the 50% DA merger was approved by the Cabinet. A website belongs to an important railway federation also flashed a news confirming merger of 50% DA is approved by the cabinet. Sometime later it changed its stand and removed the flash news

One of the News Media also confirmed that 50% DA is approved by the cabinet. But so far any announcement in this regard has not been come from the Government. Some Leaders of the Federations told, ‘when we had a talk with them, initially the central government agreed in principle to merge the 50% of Dearness Allowance and its decision was expected from the cabinet meeting held yesterday evening. But we are unaware of the reason for the government not announcing its decision.’

Earlier reports claimed that the government was considering 50% DA Merger and increasing retirement age to 62. But a source close to official side said these will be a part of Terms of Reference of 7th Pay Commission and the Panel , however, can recommend this later

7th CPC TOR and its Implications

                  First of all I thank you on behalf of Circle union for making the 12th &13th Feb strike a success, which has made the Central Government a rethink on major issues of the Central Government, the initial stand  of the Central Government as per the press statement  issued by Hon'able   Finance Minster on 25th September 2013 that the date of effect of the 7th CPC shall be from 1/1/2016, hence no IR and no proposal from the Central Government on DA merger.

                After the 12th &13th Feb strike in which lakhs of Central Government Employees participated in strike, the  Central Government  had to rethink on these issues. The Union Cabinet meeting has approved the terms of reference of the 7th CPC, if we go through it we find the 7th CPC can submit its interim report on DA merger, IR, Allowances, etc. The date of  effect of the 7th CPC is to be fixed by the 7th Central Pay Commission itself.

             Two main demands of the Central Government  Employees   have not been accepted that is one on GDS inclusion in 7th CPC and other on health scheme.        

              Now comrades it is clear we have won a half battle, many more joint struggles of Central Government employees are required to achieve our demands.
