NEW CPMG SHRI FAIZ UR RAHEMAN TOOK OVER CHARGE

Our New CPMG has resumed. We met him on the very next day on 10.07.12. It was a warm welcome to the new Head of the Circle from NFPE Unions.

I have pleasure to note that the CPMG asked us to say about our major issues for attention by administration.  We said that in the first meeting we want to only welcome and we have not come to discuss issues but the CPMG again shown interest to know our problems and we informed that we are facing acute difficulties on account of forceful attendance for various trainings etc on each and every sunday. We also represented about unbearable suppression in Vadodara region where in staff is threatened of transfer under rule 37, called in training at own cost, impractical deadlines for work, non grant of CL and manifold exploitation of staff. We also informed that NFPE and FNPO are going to start agitation for raising voice against such undue pressure on staff. 

The CPMG said that I will also give deadlines for some work. We said that there is nothing wrong in drawing any deadlines or time schedules and we are not against hard work but at the same time we can not suffer such undue pressure and threats.

We also informed that similar situation is taking place in Rajkot region also. We have already requested PMG Rajkot in the previous bi monthly meeting to be benignant and avoid undue pressure and leave harshness on trivial matters. We also urged not to cause transfer of employees by pressuring divisional heads on account of any mistake of any employee. Administration cannot be strengthened by tyranny. Employees are real tool to go ahead with any target. We are "haath-pav" of administration. We should not be unnecessarily hurt or cut. We should not be punished only for setting examples and suppressing rest of staff. The PMG assured in the bimonthly meeting itself that he has got our point and he will keep in mind now onward. There are many complaints from all corners of Rajkot region also and we are observing situation.

The CPMG asked about our next formal meeting with him. It was decided to discuss all the items in the next meeting which is due in very short time.

After certain administrative action as we expect, we will come with complete details. We know that this is a risky work. We may suffer any type of revengeful action but we hope God will be always with us if we are on the right track and working for real cause.

INJUSTICE CAUSED TO PROMOTEES IN MACP – QUASHED

v Applicant should be paid arrears with interest applicable to GPF

The full text of the judgment is furnished below in the link. What we are demanding all along (i.e) to exclude the promotions acquired by exam has been categorically declared by the Hon’ble judge. A remarkable decision.

The CHQ is referring the CAT decision to the Directorate requesting to implement the same to all without further appeal in High court or other forums.

THE GREAT LEADER OF TRADE UNION MOVEMENT IN GUJARAT CIRCLE 

PASSES AWAY

Com.B.A.Dave, a legend character, great leader, friend-philosopher and guide to all of us, a real hero of the heritage of Bhavnagar division and off course Gujarat breathed last on 1.7.2012 morning.

He was the most devoted leader of the era 1970-1990. We have learnt so much lessons from him. In the event of any perplexity, we were going to him for guidance. He dedicated his whole life for trade union movement.

We are very sad on his demise. We pray almighty for eternal peace of the sacred soul of Com.Dave dada.

HOW TO CALCULATE THE INTEREST RATES FOR GENERAL PROVIDENT FUND

             The rate of interest on GPF is generally fixed after taking into consideration the average secondary market yields on government securities. The rates of interest on General Provident Fund (GPF) is 8% for the period from 1.4.2011 to 30.11.2011 and 8.6%from 1.12.2011 to 31.3.2012, whereas the rate of interest on EPF for the financial year 2011-12 is 8.25%.whereas the rate of interest on EPF is fixed on the recommendation of the Central Board of Trustees (CBT) by the Employees Provident Fund Organisation (EPFO), Ministry of Labour and Employment based on the income earned on the accumulated fund during the financial year.

       Ministry of Finance announced on 22nd May 2012, the interest rates on General Provident Fund and similar funds, which has been revised to 8.8% (Eight point six per cent) with effect from1.04.2012.

MINUTES OF THE MEETING DATED 21.05.2012 TAKEN BY SECRETARY (POSTS) WITH POSTAL JOINT COUNCIL OF ACTION (PJCA) COMPRISING OF NFPE, FNPO AND ITS AFFILIATED ASSOCIATIONS.

            Secretary (Posts) took a meeting with PJCA on 21.05.2012 to take stock of the follow up action in regard to the discussions held in the meetings dated 10.01.2012 and 12.01.2012.

            The gist of discussions, ad seriatim, is as follows:

1.         Separate orders communicating the decision that no mail office will be closed for next three years and no dislocation of staff to places outside headquarters.

            Instructions issued vide letter No.28-8/2011-D dated 14.05.2012.  Further discussions in this regard to be held with Member (Operations) on 29.05.2012 (AN).

2.         Orders communicating the decisions about no closure/merger of post offices if no simultaneous relocation is possible.

            As discussed, a copy of the instructions issued vide letter No.40-6/2011-Plg (A) dated 21.2.2012 has been made available to PJCA.   

3.         Revision of wages of casual labourers and absorption.

            A comprehensive proposal in the matter of casual labourers will be formulated by 30^th June 2012.

4.         Revised recruitment rules for group-D & postman as agreed and syllabus for group-D examination (25% from GDS) & Postmen/Mailguard.

            Revised rules of recruitment for group-D and Postmen will be notified shortly.

5.         Revision of cash handling norms to GDS & ensuring no reduction of TRCA under any circumstances and enhancing the Bonus ceiling to 3500/- & revise the cash allowance to BPM at the rate of Rs.50/- per trip instead of month.

            The issue regarding non reduction of TRCA is under active consideration of the Department.  The issue of bonus ceiling in respect of GDS has not found favour with the Ministry of Finance. The revision of cash allowance of BPM is being processed.

6.         Orders revising the instructions liberalizing the powers to the divisional heads instead of circle heads in case of tenure posting to C and B class offices.

            The order will be issued shortly.

7.         Reiteration of earlier instructions on the grant of special pay to unqualified Accountants & Counting of Special Allowance for pay fixation without filing SLP against Bangalore High Court judgment.

            In the wake of advice of the Ministry of Finance, Department of Expenditure, there is no alternative but to file an SLP in the Apex Court.

8.         Circulation of clarification given to Punjab Circle to the remaining circles also in respect of protection of pay of defunct PO & RMS Accountants.

            The Integrated Finance Wing (IFW) has sought some further inputs on the issue and action is being taken thereon.  Once it is cleared by the IFW, it will be circulates to all heads of circles.

9.         Orders on forcible allotment of staff quarters to the town SOs SPMs as post attached quarters.

            Instructions have been issued vide letter No.18-9/2010-Bldg. dated 10.5.2012.

10.       Non supply of balance statement of NPS to the official as on 31.3.2012.

            The PJCA was informed that the statement of transactions of the subscriber for the period from 1.4.2010 to 30.6.2011 had already been dispatched to the subscribers in the form approved by PFRDA by NSDL, Mumbai vide letter dated 19.9.2011 and information in this regard was sent to all Directors of Accounts (Postal) vide letter dated 18.11.2011.  The contention of the PJCA was that no such statement was received by the subscribers till date.   The matter will be checked up with Postal Accounts Wing again and further clarification in this regard will be sent to the PJCA shortly.

11.       Enhancement of financial powers to LSG, HSG II and HSG I.

            The proposal is under examination in consultation with the Integrated Finance   Wing.

12.       Enhancing the honorarium of invigilators engaged in departmental examinations.

            The rates for honorarium for invigilators were revised vide letter dated 26.4.2011.

13.       Allowing the physically handicapped candidates for appearing in IPO examinations.

            The issue is under active consideration in consultation with the Ministry of Social Justice and Empowerment.

14.       Orders on drawal of Cash handling allowance to Treasurers, Accountants irrespective of their position in MACP.

            The PJCA was informed that a reference in this regard had been made to the Department of Personnel and Training.  However, their contention was that it being a case of financial upgradation,  the proposal should not have been referred to the DOPT.  The position will be checked up for further course of action.

15.       Finalisation of cadre review proposals before 31.3.2012.

            It was decided to formulate a proposal by 30^th June 2012 for further examination in consultation with the nodal ministries. 

16.       Payment of incentive instead of honorarium for attending the PLI/RPLI work at divisional offices after decentralization. 

The issue of payment of incentive is under process and PLI Directorate is being asked to get it expedited.

17.       Orders for repatriation of officials deputed for PLI/RPLI work to CO/RO to their home divisions. 

            Suitable instructions in this regard have already been issued to heads of circles.  However, the view point of the PJCA was that  instead of only forwarding the minutes of the meeting,  the PLI Directorate should have issued detailed instructions clearly spelling out the course of action to be taken by the heads of circles  in this regard as well as in regard to decentralization of PLI, RPLI work.   PLI Dte. will be asked to do the needful.

18.       Allowing the Postmaster’s cadre officials to appear for IPO/PSS Group-B examination. 

            The issued was discussed at length and it was decided to review it after some time keeping in view the merits and demerits of the proposal as well as the response of the officials opting for Postmasters cadre.

19.       Orders permitting the Postmaster cadre officials to officiate in HSG-I vacancies.

20.       D.O  letter from Member (P) to all circle heads to fill up all posts of Sorting Postmen, Mail Overseer, Cash Overseer & Head Postmen.

            Instructions were issued vide Member (P)’s D.O. letter No. 37-4/2012/SPB-I          dated 19.4.2012.

21.       Allowing MTS to decline promotion to postmen cadre under  seniority quota without losing MACP promotion. 

            Suitable instructions in this regard will be issued shortly.

22.       Reiteration of instruction for rotational transfer for SBCO staff by notifying cluster of divisions.

            Instructions issued vide letter No. 141-91/2012-SPB-II dated 2.4.2012.

23.       Issue instructions to all for ensuring filling up of all sanctioned LR posts.

            It was decided to examine the matter in consultation with all heads of circles with           an idea to have a clear picture of sanctioned LR posts, in the first instance.

24.       Prompt grant of child care leave – issue of instructions.

            Instructions reiterated vide letter No. 51-3/2011/SPB-2 dated 10.5.2012.

25.       Clarifications to be issued on MACP as agreed upon on the following:

(i) MACP will not be deferred on the ground of contemplated disciplinary/vigilance proceedings.

(ii) Instructions on review of ACRs/APARs by scrutiny committees.

(iii) Recovery orders by DA(P) in the matter of pay fixation on MACP in case of MTS.

(i) Cases relating to declining promotion prior to issue of MACP order (prior to 2009).

            Suitable instructions regarding (i) above are under issue.  Instructions regarding (ii) have already been issued.  The issues raised at serial number (iii) (iv) are under examination.  The PJCA requested for issue of an early order in respect of cases where the officials declined promotion prior to issue of MACP order in 2009.

26.       Issuing clear instructions to all CPMGs that in the city areas where RO/COs are situated decentralization of RPLI/PLI should not be done to city Postal Divisions, instead the work will be done by RO/CO staff as done before.

            The PLI Directorate will be asked to issue detailed instructions in the matter of decentralization of PLI/RPLI instead of merely forwarding the minutes of the meeting.

27.       Issuing orders on the items finalized by the Postmen committee and also follow up action on certain items to be referred to work study unit.

            A committee constituted to consider the issues relating to Postmen has already submitted the report.  The recommendations of the committee are under process. 

28.       Cadre-structuring and settlement of Group-D and Sorter anomaly issues relating to Postal Accounts. 

            The matter will be pursued further with Postal Accounts Wing and Establishment Division and the PJCA will be kept apprised of the progress in this regard.

29.       Follow up action on civil wing employees issues.

            The recruitment rules are presently pending with Ministry of Law and Justice.  Will be notified immediately after it is cleared and further action to fill up the posts will be taken.

30.       Examination of CRC & EPP norms.

            It was decided to have a meeting with Member (Operations) on 29.5.2012 (AN) to discuss the norms.

            Before concluding the deliberations, Secretary (Posts) brought to the notice of the PJCA about the serious problem which Department is facing in the form of abstraction  of articles from Postal parcels and regarding delayed dispatch, mis-sorting & delivery of Speed Post articles.  The PJCA was informed that lot of complaints have come from Hon’ble Members of Parliament also through news papers alleging abstraction of articles by Postal employees which is adversely affecting the image of the Department,  besides affecting parcel post traffic.  Secretary (Posts) desired all members of PJCA may advise the employees of the Department to desist  from adopting such anti departmental activities, which are detrimental to both the Department as well as its employees during course of their meetings/conferences and consultations etc.

ALL INDIA POSTAL EMPLOYEES UNION - GDS (NFPE) CHQ GIVEN PROGRAMME OF ACTION ON GDS DEMANDS.

1.      A Draft 32 Points Charter of Demands that has been prepared by the CWC covering all the demands of the three lakhs of GDS employees will be placed in the CHQ website, inviting further suggestions for improvement by the rank and file. The entire attention of our organisation will be focussed to win the above demands through a united movement of Postal Employees under the able guidance of the NFPE.

2.  A Programme of Action starting with a day-long Dharna/Demonstration in front of all the Chief Postmasters General Offices/Postmaster Generals Offices/Divisional Offices will be organised on 28-06-2012.

3.      After participating in the March to Parliament on 26th July, 2012 called for by the Confederation of CG Employees and the All India Convention organised by the NFPE on the same day at New Delhi, a massive Dharna exclusively for the GDS Demands will be organised in front of Parliament on 27.07.2012.

4.      A comprehensive Memorandum on GDS Demands and issues will be submitted to the Government and the Department on the day of our Dharna on 27th July, 2012. Further the memorandum will be submitted to the Govt. through MPs also.

5.      Meeting the Honourable MoC&IT at a later date to focus attention on our urgent Demands after the Dharna before the Parliament.

           It is requested to prepare / make all arrangements to conduct the program on 28-06-2012 in all circles and travel arrangements to Delhi for "March to parliament" & NFPE convention on 26-07-12 and "Mass Dharna at Parliament by GDS employees" on 27-07-2012 i.e., two days stay in Delhi and ensure the programs will be grand success with large participation of all NFPE & GDS membership.

The tickets for travel inside the State will be arranged by the concerned State Committee secretaries, whose names and phone numbers are given. The return and forward journey may be arranged by the concerned individual leaders deployed for each station. The deployed comrades are requested to reach the destination in the morning itself. The State Secretaries may arrange for more than one meeting in a station. For the facility of maximum coverage the visiting leaders may form groups to visit the offices. The affiliates are requested to give necessary instructions to their field formations to mobilize their members to participate in the March to Parliament programme and see that their journey tickets are booked well in advance.

A REPORT OF 1st CWC MEETING OF AIPEU - GDS (NFPE)HELD AT HYDERABAD, A.P CIRCLE.

Dear Comrades,

            The 1st Extended Central Working Committee meeting of our AIPEU GDS[NFPE] was held under the leadership of our CHQ President Comrade Bijoy Gopal Sur on 23.05.2012 at Sundarayya Vighyan Khendra, Hyderabad [AP].  The CWC commenced with the hoisting of NFPE flag and GDS Union flag by Comrades Bijoy Gopal Sur CHQ President and Vijay Krishna Vice President of GDS Union of AP respectively amidst slogans renting the air

The Reception Committee headed by Comrades K.Ramachandram Convenor Postal Circle Co-ordination Committee, DASV.Prasad, CS P3, SSRA.Prasad ,Assistant Circle Secretary P3 and K.N.Chari Treasurer, GDS Union AP Circle has made excellent arrangements for the conduct of the CWC as well as the accommodation of CWC Members and participants.

Inaugural Session:

            The CWC was inaugurated by our beloved Secretary General, NFPE Comrade M.Krishnan. The CWC was attended and addressed by Comrdes K.Ragavendran [Working President of Confederation of CG Employees & Workers]; K.V.Sridharan [General Secretary P3]; Ishwar Singh Dabas [General Secretary P4]; Giriraj Singh [General Secretary R3]; R.Seethalakshmi [Assistant Secretary General NFPE]; P.Mohan [General Secretary Postal Casual Labour Union]; R.Shivannarayana [Deputy GS P3]; Veeramani [AGS P3]; Y.Nagabooshanam [Working President Casual Labour Union]; K.Ramachandram [AGS & Circle Secretary Admn Union]; Sk.Humayun [CHQ President P4]; DASV.Prasad [Circle Secretary P3 AP]; R.J.Madhusudana Rao [Circle Secretary R3 AP]; and Comrade M.Nagavardhana Rao [RJCM Leader AP]. All General Secretaries and other leaders assured total cooperation and solid support to our GDS Union in building a strong organisation for us as well as in unitedly fighting to win the issues of GDS. They guided us to function democratically and with the motto of unity and struggle for advancement of the cause of GDS.

GDS CRUSADER:

During the inaugural session, the first copy of the All India journal of our union “ GDS Crusader” was released by the General Secretary of P4 Union Comrade Ishwar Singh Dabas and was received by Comrade Giriraj Singh General Secretary R3 & Com.V.Vijayakrishna, Circle Vice President, GDS.

Subjects Committee:

All the CWC Members narrated the actual organisational position in their respective Circles. It was observed that the 1st Circle Conference of AIPEU GDS [NFPE] has been successfully held at Kerala Circle. Each Circle position explained by the CWC Members enthused all as it was clear from the deliberations that the GDS are joining our Union en-mass in many circles and in many divisions in different circles. The CWC also noted the Circles where the process of enrolling membership has not picked up momentum and decided to take appropriate organisational measures including intensive tour by the CHQ Office Bearers to expedite the formation of our union in all circles.

Important Decisions:The CWC after the inaugural session in which all the above leaders elaborately dealt with the issues of GDS and the task before our GDS Union in resolving them through united organisational measurers and struggles sat in its subjects  committee. All the Office Bearers and Circle Secretaries participated in the discussion on all matters of agenda items.

I.        Union Constitution:

The CWC unanimously adopted a Constitution for the AIPEU GDS [NFPE].

II.      The following important decisions have been taken unanimously on the issues of GDS:

1.       A Draft 32 Points Charter of Demands that has been prepared by the CWC covering all the demands of the three lakhs of GDS employees will be placed in the CHQ website, inviting further suggestions for improvement by the rank and file. The entire attention of our organisation will be focussed to win the above demands through a united movement of Postal Employees under the able guidance of the NFPE.

2.       A Programme of Action starting with a day- long Dharna/Demonstration in front of all the Chief Postmasters General Offices/Postmaster Generals Offices/Divisional Offices  will be organised on 28-06-2012.

3.       After participating in the March to Parliament on 26th July, 2012 called for by the Confederation of CG Employees and the All India Convention organised by the NFPE on the same day at New Delhi, a massive Dharna exclusively for the GDS Demands will be organised in front of Parliament on 27.07.2012.

4.       A comprehensive Memorandum on GDS Demands and issues will be submitted to the Government and the Department on the day of our Dharna on 27th July, 2012. Further  the memorandum will be submitted to the Govt. through MPs also.

5.       Meeting the Honourable MoC&IT at a later date to focus attention on our urgent Demands after the Dharna before the Parliament.

III.    The following decisions have been taken on our Union Organisation:

1.       Conduct the enrolment  of membership to our  union in all circles at the earliest and organise divisional conferences and then Circle Conferences during the months of August, September and October to elect leadership democratically at all levels. The first All India Conference will thereafter be held in Andhra Pradesh in the month of December,2012 / January,2013.

2.       To build a strong subscriber base to our CHQ journal GDS Crusader by collecting the annual subscription of Rs.60/- per member.

IV.    Decisions on Finance of our Union:

The CWC unanimously decided to strengthen the financial position of  our CHQ as an urgent measure and various Circles have been given quota of donations to be completed within a time frame before 15th June, 2012. The CWC noted with thanks that ‘GUDUR NFPE UNIONS’ the home division of our General Secretary have donated a laptop to the GDS General Secretary for efficient functioning.

The new union AIPEU GDS[NFPE] has been necessitated in order to achieve major gains for the GDS through unity with all regular employees unions under the NFPE. We cannot win without uniting with all under the NFPE unlike some who thrive on anti-federation and anti-unity tirades that only weaken the cause of the three lakhs GDS. Trade Union democracy will be the cornerstone of our functioning and unity with all and struggle for emancipation of GDS will be  our direction. Whatever we have achieved had been the result of united struggle by the entirety of the Postal Employees Movement and not the result of any one organisation or individual. Let us understand that very clearly and take a resolve to strengthen our comradely bonds with all organisations and function shoulder to shoulder. Let us go to every GDS in the country and explain the reality in total and build a very strong trade union organisation for the GDS that really wins

GDS CHARTER OF DEMANDS

1.       Departmentalization of Gramin Dak Sevaks and grant of all benefits of departmental employees to GDS.

2.       Constitute 7th CPC and refer GDS wage revision also to the consideration of Pay Commission.

3.       Merge 50% DA with TRCA of GDS.

4.       Cancel the new GDS (Conduct & Engagement) Rules, 2011 and restore GDS (Conduct & Employment) Rules.

5.       Ensure minimum statutory monthly pension of Rs.3500/- to GDS and grant other pensionery benefits like gratuity etc., based on the formula applicable to departmental employees and under Gratuity Act 1972. Extend family pension facility to GDS also.

6.       Grant three time bound financial up gradations  to all GDS on 10th, 20th and 25th year.

7.       Enhance the bonus quantum ceiling from Rs.2500/- to Rs.3500/- and end the discrimination.

8.       Reduce cash handling norms from Rs.20,000 to Rs.4,000 and also stamp sale norms.

9.       Ensure full protection of existing TRCA when there is fall in the work load. TRCA should not be reduced under any circumstances.

10.   Remove the 25% outside recruitment quota for Postman Recruitment  and 100% Postman vacancies be given to GDS.

11.   Remove the 50 points compulsory condition for compassionate appointment and provide compassionate appointment to all eligible dependents.

12.   Introduce medical reimbursement scheme for GDS.

13.   Grant full trade union facilities including special casual leave and foreign service facilities to GDS Union representatives.

14.   Grant 6 months maternity leave to female GDS instead of three months.

15.   Grant all advances to GDS at par with regular employees.

16.   Grant full transfer facility to GDS. Grant protection of the existing TRCA on transfer.

17.   Grant revised TRCA slabs upto 125 points to BPMs based on the workload as on 01.01.2006.

18.   Stop combination of duties of GDSMD with that of BPM as it will result in restriction of business hours of BO thereby causing loss of revenue.

19.   Enhance age limit for the departmental examination for promotion to the cadre of Postal Assistant from GDS at par with Postman cadre.

20.   Modify date of superannuation of GDS as the last working day of the month.

21.   Remove the ceiling limit of Rs.50 for cash allowance for conveyance of cash from BO to AO and vice versa.

22.   Grant of LTC and  home town LTC facilities to GDS.

23.   Remove the discrimination in grant of welfare assistance to GDS in respect of prolonged illness, Book awards, educational assistance etc,.

24.   Provide norms for MNREGS work at par with SB transactions and also cash conveyance from BO to AO and vice versa.

25.   Cancel the embargo of fixing of minimum TRCA in respect of new appointees. Minimum should be the entitled TRCA drawn by the earlier incumbent. No fresh statistics to be compiled.

26.   Fix norms for all new items of work entrusted to GDS and until then grant enhanced incentives.

27.   Payment of rent for BO to be borne by the department and till that time grant enhancement of Office Maintenance Allowance.

28.   Redeployment of GDS should not be done beyond 5 kms and full protection of TRCA should be given in case of redeployment from one post to another.

29.   Prompt issuing of SDBS cards to all GDS employees.

30. Grant Children Educational Allowance and small family incentive to all GDS.

31. Fill up all GDS posts in RMS and convert GDS MM posts as MTS.

32. Make early payment of RPLI incentive and remove the minimum condition and maximum

       limit in grant of NREGS incentive
