Modified instructions on Recruitment of GDS through Employment Exchange - Clarification of term "Effective No. of Candidates

Attention of all concerned is invited to Para 3 of this Dte Order No. 19-4 / 97-ED & Trg Dt 19.08.98 which provided that "in case the notification and public advertisement so issued fail to elicit any response within the stipulated date or if the effective number of candidates applied for the post is less than 3, the vacancies will be re-notified to the Employment Exchange & fresh advertisement issued calling for nominations etc within 15 days"2. The term "effective No. of candidates / applications" has undergone judicial scrutiny by CAT, Hyderabad in OA No. 516 / 2009 in the matter of Shri.Chennuri Raju vs Union of India & relying on judgment of High Court of Madras in WP No. 22500 & 20422 / 1999 in similar case CAT, Hyderabad has held in its judgment on 15.06.10 that "three effective applications mean three applications should be received and even if one of the candidates amongst the three applicants is eligible, the selection should be finalized"3. The issue has been considered in this Dte in the light of the aforesaid judgment and I am directed to convey that term "effective No. of Candidates" finding a mention in the order of this Dte ibid may be interpreted to mean that three applications from the different candidates should be received and even if one of the candidates amongst the three applicants is found eligible, the selection should be finalized in conformity with the interpretation as referred to in

3. The Directorate has not received response from any Circle so far. The acknowledgement for the communication dated 01.09.2010 was received from Gujarat, MP, Orissa, and UP Circle only.

4. The applications of Divisional Heads for registration as Collection Centres are supposed to be sent to concerned DAPs for counter signature and onwards submission to Directorate by 25.09.2010.No DAP in the country has so far sent the applications for registration as Collection Centres and Accounts Offices. This is a time bound issue on which the Department has given an assurance to Parliamentary Standing Committee on Ministry of Information and Technology.

5. The Circles Heads are requested to expedite submission of the applications of concerned Divisional Heads for registration as Collection Centres and also that concerned DAPs for registration as Accounts Offices to reach Directorate immediately for submission and Development Authority (PFRDA).

6. Action is required to be for obtaining the options and applications of Gramin Dak Sevaks and their submission to concerned Central Record Keeping Agency (CRA) facilitation centre for issue of digitized smart cards. The applications have to be forwarded to concerned Central Record Keeping Agency (CRA) by 10.10.2010 along with the details of GDS opting for the scheme in the prescribed proforma.

7. The Circle Heads are requested to send compliance on para 5 and 6 immediately for submitting the position to Secretary (Posts).

Sub: Interest bearing advance /Sixth Central Pay Commission recommendation on House Building Advance-enhancement in past – regarding

The undersigned is directed to invite attention to this Ministry's O.M. No. 1-17011/11(3\4)/2008-H.III dated 27th November, 2008 on the above subject and to say that it has been decided in consultations with Ministry of Finance to make the afore-said orders applicable with effect from 1st January, 2006. Accordingly, an enhancement of House Building Advance, if applied for, may be granted for an amount equivalent to the difference between the previously sanctioned amount and the new amount determined on the basis of pay in the pay band, in past case, where HBA was sanctioned on or after 1-1-2006 but before 27-11-2008 subject to complying following conditions:

(a) The Government servant should not have drawn the entire amount of HBA sanctioned under earlier orders and /or where construction is not completed /full cost towards acquisition of house /flat is yet to be paid.

(b) There will be no deviation from the approved plan of construction on the basis of which the original sanction of House Building Advance was accorded. The revised cost of the original plan can, however, be considered for determining the additional amount, subject to the prescribed maximum limits.

(c) Supplementary Mortgage Deed, Personal Bond and Sureties will be drawn and executed at the expense of the loanee.

(d) The actual entitlement will be restricted to the repaying capacity computed on the basis of the formula laid down in this Ministry's O.M. No. 1-17015/16/92-H.III. dated 17.10.2000. It should be ensured that the entire amount of advance with interest is recovered before retirement on the Government servant.
(e) Rate of Interest: The rate of interest chargeable in such cases would be as per the slab applicable to the total sanctioned amount i.e. amount already sanctioned on or after 1-1-2006 but before 27-11-2008 plus the enhanced sanction. However, the new rate of interest would be chargeable only on collective amount that would remain outstanding on grant of enhancement of HBA i.e., the unpaid portion of previously sanction HBA plus the enhancement so granted. Thus, the amount of HBA that has already been re-paid on old rates will not attract the fresh interest charges.

2. However, the existing limit of maximum admissible amount of Rs. 7.50 lakh for the purpose of construction /purchase of new house /flat and Rs. 1.80 lakh would remain unchanged. In other words, the sum total of previously sanctioned HBA and the enhancement granted under these orders cannot exceed the aforesaid limits. In nay case, not more than one enhancement is admissible to Govt. employees.

3. The applications for enhancement HBA should be submitted within six months from the date of issue of this order.

4. Ministries/Departments whose branch offices are situated in the far flung areas like in case of Ministry of Defence, etc., are advised to give wider publicity to these orders through modern communication means like facsimile, e-mail, web-site, etc. so that there is no occasion for any representationfor extending the time limit of six months on the grounds of receiving these orders late.

Circle secretary’s visit to Amreli Division

There were certain issues requiring dialogue with Divisional Administration in Amreli Division. Amreli HO is now modernized under Project Arrow. This is a scope for improvement by vice – a –versa communication between the Post Master and Staff. It also comes in to the notice that there is also acute need of new computer systems, printers and allied accessories. The Postmen staff also made tenderness from their supervisory staff. The problems are not so big and ultimately administration and staff has to work in one line by providing better public services and increase the revenue. The S/Shri Sharad Terraiya the organizing Secretary CHQ and Circle President P4, Rashmin Purohit Circle Secretary P3 & S K Vaishnav Asst. Circle Secretary accompanied by M P Mamgloriya D/S P3 & G T Gondiya D/S P4 visited on 11-10-2010 to meet SPO’s Amreli Division in due monthly meeting and discussed the issues at length. The response of administration was very cordial. One Shri S P Dave retired Dy. PM Amreli HO met the leaders of the union and it was sad to know that his retirement benefits including DCRG and commuted value of pension, worth Rs. 7-8 lacks, were stopped by the Department, without any written orders served to the official. The matter was also represented before Hon’ble SPO’s and he assured to look in to positively.

DEPT OF POSTS WANTS IRDA TO REGULATE ITS INSURANCE PLANS

In a first significant step towards consolidating similar financial products under one regulator, the department of posts (DoP) is exploring the option of handing over the regulation of its insurance products to the sector regulator, Insurance Regulatory and Development Authority (IRDA), a move prompted by the ugly spat between the insurance regulator and the stock market watchdog, Securities and Exchange Board Of India (SEBI), over the regulation of unit-linked insurance products (ULIPs).
The DoP has sought the law ministry's opinion on whether the insurance schemes run by it could be brought under the regulatory ambit of the IRDA. It has also proposed to create a corporate entity to handle the schemes.
The decision to refer the matter to the law ministry was taken after the IRDA expressed its inability to regulate financial activities of the government (the DoP), which controls the insurance business of India Post, a government official told ET.
The finance ministry has favoured setting up of a corporate-like identity to handle India Post's insurance business that can be regulated under IRDA norms, said the official, requesting anonymity. While the IRDA is not opposed to the idea, it wants greater clarity on the matter as it will require changes to the legal framework that govern the insurance policies of the postal department.
The opinion of the law ministry could pave the way for bringing the insurance business of the postal department under the IRDA's jurisdiction. The department, which sells policies under the postal life insurance and rural postal life insurance schemes, acts within the framework of the Insurance Act. The IRDA has also pointed out that with the premium calculations of the postal department not on an actuarial basis, the postal life insurance schemes could be notching up serious deficits.
The postal department feels that an IRDA-regulated framework will allow it to make the scheme more flexible. The DoP, which acts as an agent of the finance ministry for its insurance schemes, lacks autonomy required to introduce new schemes or even providing attractive discounts to lure customers.
"The department is required to seek direction from the finance ministry for all policy matters like extension of scope to cover other clients and introduction of new products," said an official with the ministry of telecommunications and IT.
Even as the debate on regulatory control of postal life insurance goes on, the department has also requested for greater autonomy to its insurance schemes as it looks to expand its financial services business. "Corporatisation of the life insurance business will enable the postal department to compete with private insurance players on a level playing field," said the postal department official.
Private players have welcomed the move. "The move will help bring consistency in norms and activity pertaining to life insurance business," said Kapil Mehta, MD & CEO of DLF Pramerica Life Insurance Company of India. He added that the proposal, when implemented, will provide the postal department a level playing field as regards right products and schemes into the rural segment, which has been the primary focus for private players as well.

PRESENTATION ON THE TECHNOLOGY TO THE CIRCLE/GENERAL SECRETARIES

The Department has organized a presentation to the Staff Side on Technological developments that have already taken place/or under process on 23.10.2010 in Postal Staff College of India, Ghaziabad. Secretary (P), Member (T) & Member (P) will present.

This is the first time, the department recognizes the importance of base level leaders for their involvement in the developmental activities of the department and invited all the Circle Secretaries of P3 Unions besides General Secretaries.

In between, on the invitation of Royal Mail U.K, a Postal Training programme in UK has been organized in London from 18.10.2010 to 22.10.2010 and ten member delegation is attending from the department our Secretary General Com. M. Krishnan, and our General Secretary, Com. K. V. Sridharan are also among the ten members delegation.

Since the Secretary General & General Secretary could not be available on 23.10.2010, the delegation of circle secretaries will attend the Postal Training Centre with one of the authorized representative from Federation & CHQ.

In order to provide transport facilities to the Training centre from Delhi, We are arranging a vehicle from CHQ. It will start at 07:30 AM on 23.10.2010 sharply. All Circle Secretaries are requested to be present at CHQ if desire to go as one team. In case if any had already booked ticket upto Ghaziabad earlier, they can meet the team and had a discussion in the Postal Training College before attending the meeting.

This is a good beginning and therefore we don't want to seek the programme be postponed. All Circle Secretaries are requested to attend the meeting without fail.

Respected sir,
It has been bitterly represented by the concerned staff in Bhavnagar division that the System Administrators’ has to impart training of various software applications to supervisory staff on Sundays, as per instructions through email by C.O. Staff side is off course prepared for extra and hard work in view of need for total computerization of postal work and trainings for those who need to know more and expertise themselves in view of accurate and adequate functioning of entire machinery, but it is requested to consider that family members and school going children finds only Sunday to remain in company of each other. For serving couples also it would be very uneasy to work on Sunday at office. The staff may sit extra hours and do the work as required instead of loosing Sunday’s off. The purpose of imparting training can be served by imparting trainings till late evenings.
It is therefore requested to review the instructions given in the matter in light of above representation.
The issue in question does not pertain to only Bhavnagar division but to all other divisions where such instructions are given.

It has been complained by many of our members that the above festival which is based on appearance of moon has been erroneously declared on Friday 10th September though the idd was to be celebrated on Saturday the 11th. In Gujarat as well as all other portion of the country, the festival was declared and organized on 11th and therefore it is our curiosity to know as to on which basis the idd holiday was declared on the 1oth, though moon appearance was not confirmatory with the proclamation. I may also mention here that many of the employees belonging to Muslim community had to take leave for Saturday due to erroneous proclamation of closed holiday.

The items to be taken on agenda of the next four monthly meeting are furnished below:

ITEM No.1
PROBLEMS PERTAINING TO TECHNOLOGY APPLICATIONS, MAINTANANCE AND OVERALL SYSTEM ADMINISTRATION.


(i) Proper maintenance, installation of licensed antivirus and AMC wherever feasible and keeping spare PC/Printers in big offices.

From various offices it is noticed that every now and then systems are not working properly. Adequate numbers of systems/printers are not available and in many offices problems occur for want of licensed antivirus. Availability of at least one spare PC/Printer in big offices would avoid interruption in public work. Annual maintenance Contracts would also help in proper maintenance as per standards. It would also be important to know how many repairable systems are lying unrepaired and how many irreparable systems are lying in POs and whether new one has been supplied in place of that becoming irreparable. In many cases history sheets may not be available even if the irreparable systems require condemnation. It is also brought to our notice that due to salty air and moisture in coastal area problems occur more in comparison to other areas and as such in such area safety measures for up keeping of systems and keeping spare systems may be considered. It is requested to undertake a survey to unveil real picture and plan for remedial action in view of appeasing problems and thereby enhancing efficiency of staff side.


(ii) Reimbursement of fuel expenses incurred by System administrators.

We know SAs are real pioneers of computerization in the Department of Posts as they manage to install, run and maintain various software’s, without any remuneration. In any case, they cannot be asked to visit various offices for trouble suiting problems at their own cost. Even if the matter may be under consideration at any level, the employees cannot, in the meantime, incur expenses from their own pocket. Some instructions are necessary in the matter.


(iii) Review of performance of EMOs software.

In some cases, EMOs actually paid at the office of payments are received back with remarks as ‘deceased’ and repaid to remitter also and results in double payment. This is very critical matter requiring immediate action.

ITEM No.2:
RECOGNISATION OF MULTI SPECIALITY HOSPITALS AT BIG TOWNS/DIVISIONAL HEAD QUARTERS.

In cities like Ahmedabad, Baroda, Rajkot etc. some multi speciality hospitals are approved by the department. It is requested to extend co operation by inviting and emphasizing proposals from all big towns and divisional head quarters for approval of multi speciality hospitals. This will help staff in availing appropriate and prompt treatment.

ITEM No.3:
PROMOTION OF STAFF WELFARE.

(i) SPACE FOR CO OPERATIVE SOCIETIES/UNION OFFICES:
In some divisions like Porbandar, attempts are made to withdraw the space allotted for functioning of Postal Co operative Credit societies under one or other plea. Same problems are with the Union offices in departmental buildings. In case of real difficulty in continuing present arrangement alternative space may be given as far as possible to extend co operation to staff in such welfare activities.

(ii) ALLOTMENT OF ONE QUARTER IN ANY P&T COLONY AT AHMEDABAD FOR USE AS OFFICE OF AIPE UNION GROUP.C GUJARAT CIRCLE.

nfidentially. Our union having huge membership needs a quarter for the purpose of using as office of the union. We are ready for payment of due charges for the purpose. There may be quarters vacant in some colonies and we request allotment of one quarter to us.

TECHNOLOGICAL DEVELOPMENTS IN DEPARTMENT OF POSTS-PRESENTATION TO THE STAFF SIDE ON 23.10.10

Dear Comrads,
A presentation will be made to the staff side on technological developments that have already taken place/or under process, in the Department of Posts. The presentation is scheduled on 23.10.10 in Postal Staff College, Ghaziabad and will be made by Technology Division in the presence of Secretary (P), Member (Technology) and Member (P). All Circle Secretaries of recognised P.3 unions affiliated to NFPE and FNPO will participate in the presentation. General Secretaries and Secretary General of Federations will also attend the presentation. Our Circle Secretary Com.Rashmin Purohit will also participate in this vital event and make a report on this blog after returning from Ghaziabad on 24th.

POSTAL DEPARTMENT MULLS MARKET PRICE FOR BIZ, SPEED POST

PREMIUM, postal services, such as business mails, logistic post and speed post, will get expensive as the government looks for ways to bring down the deficit of the postal department, which is running into thousands of crores. The department of posts (DoP) is considering a market based pricing for many of its products that do not have a social dimension to them to reduce the government subsidy. The idea is to have a sustainable costing and pricing mechanism for postal products and services, even as services are kept affordable for the common man, "said government official in the department of telecommunications and information technology.

The department plans to get the new tariff structure in place before the budget session of Parliament next year and has decided to commission a study by a private consultant to freeze the proposal quickly.

Tariffs for products, such as post cards and inland letters that are used by the poor are not likely to be raised.

Post cards cost 50 paisa each while an unregistered inland letter costs Rs.2.50, well below what it takes DoP to deliver them. According to estimates , India Posts tariff is 70% cheaper for domestic destinations and 30% cheaper for international destinations , when compared to the tariff charged by private courier agencies .As per estimates, the department is expected to generate revenues of Rs.6956 crore, way below its working expenses of more than Rs. 10552 crore.

SEEKING FEED BACK FOR AGENDA FOR FOUR MONTHLY MEETING DEC.2010

There are so many problems in every divisions coming out of process of application of technology and total computerisation. The problems may be on any of the following reasons:
non availibility of sufficient number of Printers/PCs
non availibility of spare printers etc.
for want of licensed antivirus.
systems laying irreparable but not condemned as per proceedure.
non availibility of history sheets.
systems reparable but divisional heads not attending to problems.
system administrators remain overburden and unable to solve problems in time
well known problems in our softwares
no reimbursement of fuel charges actually incurred by SAs in goint to local offices
any other reasons

I request all Divisional Secretaries and System administrators of all divisions to give me feedback about their experience, suggestions and point of representation which we may take up with higher authorities. Details of each division with particular type of problems, particular office and other specific details be given to me to enable to represent in right way with concrete examples. I will invite some of SAs to directly interact with administration.
